Employment rights - constructive dismissal?

Was looking for some advice please, I am currently a manager at a multi-national whom has 2 sites in the UK. At Xmas the group HQ decided to make half of the workforce redundant at my site, the other site was left untouched.

As the new year progressed it was immediately apparent that the existing workforce was not enough to cope with the existing order book, however HQ refused to sanction the recruitment of additional staff. To make up this deficit the Factory Manager implemented the scheme of putting 6 supervisors whom were off the job as part of their roles working directly on production lines. 2 of these Supervisors reported to myself.

This had the desired effect in terms of mobilising additional bodies, however as a bi-product this meant that I was forced to do the duties of my subordinates as well as my own job. This status quo remains the same now.

What has grieved me about this situation is that our sister site in the UK still has off the job Supervisors and my peers carrying out the same job function/job description as myself have the ability to delegate down to their Supervisors whereas I do not. Is this legal? What is the recourse for this? My manager is not unsympathetic as he is in the same situation as myself but does not have the ability to offer a solution. I feel like I am being treated differently to my peers, any advice would be gratefully accepted.

You would have to resign first if you wish to claim constructive dismisal. Doesn't sound like you have much to complain about either.

You are getting the same pay for doing a (part) lower status job. Where is the problem?

    It is totally legal.

I wouldnt go down a constructive dismissal route, that would be a hiding to nothing, this is down to good old management and negotiation I am afraid.

That's not how I read it. I read it as Gavlaar is now having to cover additional supervisory duties as those supervisors are now doing a manual role.

Unless he is doing extra hours unpaid, there is no issue.

Correct, I am having to pick up the duties of my 2 subordinates as well as my own duties whilst my peers do not

What you peers do or not do is of no relevance to your situation. Unless you are claiming discrimination on prescribed grounds.

I work for the same company doing the same job as my peers with the same job description - what is unreasonable about this

No law that says every employee with the same title has to do the same job. They can also pay you a different amounts and there is nothing legally wrong with that. This is the world of work, not primary school and things aint always "fair".
