Claiming against council for damage to car (NOT potholes)

If the insurance company become involved they'll want evidence.
As it stands you don't have any.0 -
But your evidence is circumstantial. You still have no proof that the council vehicle did the damage. It could have been a delivery van, a neighbours car etc etc.
Whilst generally I am with the others in that you dont have much hope you do ultimately have to prove it on the balance of probability and not beyond reasonable doubt.
The road sweepers we have the brushes extend beyond the edge of the vehicle so that it can do the kerbs/ gutter. If it was close enough to graze the side of your car I would expect to see brush marks that went under your car not just close to it unless you have some insanely flared wheel arches0 -
Councils will try and wiggle out of anything. I've seen council vehicles rip door mirrors off parked cars before and drive off. "Didn't see it guv.." yeah right.
Never mind dash cams while driving. We need all round cameras on our cars that film everything while parked.0 -

I have a beetle, so they do stick out a bit..0 -
The road marking is not conclusive either as they could also argue the road mark was made before you parked there.
If a minor scratch, it is often easier to get one of the mobile body repairers to attent to it, often less than the cost of your excess and no need to claim on your insurance.
Corroboration is king - without it, it is simply luck if you get a payment.0 -
Is there any paint from the council vehicle, on your vehicle??
I used to have a problem with dust carts hitting my wall with the back end as the turned. A couple of times they actually looked at the damage to their vehicle, but just drove off, but that's another matter. On one occasion their vehicle had just been repainted, and I was able to take paint samples from the bricks on my wall. So I had them bang to rights.0
