Under the BPA Ltd Code of Practice that they are signed up to they must allow an appeal to POPLA whether pursuing the keeper by virtue of POFA or going 'old school' & chasing the driver without recourse to POFA.0

They can't pick and choose on what parts of pofa 2012 they are using, they got the RK details under pofa 2012, if that is the case they got to follow the rest of pofa. Access to the dvla is on the proviso that they comply with the BPA Code of Practice, I would register a complaint to the dvla and bpa, forward the letter where they say they can disregard pofa.

Ahh ok, grr! I actually don't know who the driver would have been because they sent it to me about a month after the event.
They also told me that I couldn't apply to POPLA (as it was not issued under the POFA) which I think is rubbish. So, apart from me emailing asking for a reference so I can refer it to POPLA, and then saying that I can't, we've had no further communication!
That is rubbish. Respond and tell them they are wrong and that you are allowed a POPLA code, and that if they refuse you will report them to the BPA and DVLA AOS Compliance Manager. Here's what to do, a template set of complaints for a similar situation (a letter from PCS which is not compliant with the law, like yours):

That poster, Broadsword, is an expert campaigner against fake PCNs, with real clout with the DVLA so do as he says to kill this stone dead. Tweak the dates and details on his template complaints and send them off just as he directs that poster to do.
Which PPC is it? ANPR Ltd perhaps, or P4Parking? I ask because PCS are not the originator, not a parking firm. They are a debt collector who miss the deadlines far too often and who hide the name of their client somewhere on that Notice.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
