NewGeneration Parking Management - getting your money back

Options
My parents paid a fine of £60 as they were worried that it was going to be more and appealed to POPLA. The appeal was allowed but they have not been able to get a refund despite writing several letters and making several phone calls. Any suggestions?

    How did they pay? If it was by credit card, they may be able to get restitution via the card company but frankly, the record of getting money back from these parasites is not good.

    As they are BPA AOS members, a strongly worded complaint to the BPA about them ignoring a POPLA decision might help but I fear they may need to go as far as the small claims court and co-naming the landowner/retailer concerned in the action might be what you need to do.

    If you go to small claims court, the type of claim is a debt action. Your evidence is the POPLA decision, documentary evidence that you paid the money, and your letters attempting to get it back.

    You need to do a letter before claim before issuing proceedings.

    Depending on your parents' financial means they may be entitled to a fee exemption, but if not the fee will be added to the judgment debt, and will be payable by the PPC.

    If you decide to go down this route, do come back and we will help you with the letter before claim.

    A good idea, but look at zzzlazydaisy's thread on what pre-court action you need to do before issuing a LBC.

    And of course if you don't hear from them in say 14 days, you could always send a gentle reminder saying something like

    'I refer to my letter of [date]. I am disappointed that I have still not received a response from you. Unfortunately you leave me with no alternative but to put you formally on notice that if I do not receive a cheque from you in the sum of £60 by 4pm on [give a date say 10 days later] I will take advice with a view to commencing legal proceedings against your company for recovery of the debt.'

    This ^^^ serves as a halfway house. It is a step before a formal 'letter before claim' but makes your position very clear.

    But hopefully none of that will be necessary :-)
