Speeding ticket and insurance.

Before you ask no its not me I'm fully insured.
A friend has just got ticket in the post for speeding, £60 or go on a course, the problem he as is that his girlfriend was driving at the time and he now knows that she wasn't covered on the insurance. She told him her own insurance covered her in his car and he believed her but a day later while checking her policy he realised she was mistaken and stopped her using his car again but now 10 days later he gets this letter. He knows he has to fill in her details on the form but is worried that she will get done for no insurance so told me he was thinking of just taking the points himself and just getting it over with but I'm worried that he could get in trouble if found out. Do the police check insurance status or can she just pay up and get off with 3 points?

Can I give you some very good advice.
Keep well out of this, they could end up in court for perverting the course of justice and you for conspiracy if you assist them and they make a false declaration.
If they can and did jail a serving MP, they wont hold any bars here.
All the advice they need is printed on the forms the police sent to them.

First of all, your friend should not lie at any point. If they do and it is discovered (from the photos/video they are likely to be able to tell whether the vehicle was being driven by a male or female) then there is only one way out of the situation and that is via a prison van. It is not worth the candle.
What your friend almost certainly has is an entirely standard Notice of Intended Prosecution which incorporates a requirement that they name the driver at the time, if they were not the driver themselves. That form, once completed, will go to a central unit who do nothing but check and issue these forms. They do not issue "producers" and are only interested in the driver at the time. The chances of them checking to see if everyone named is insured is, I believe, slim as it would add significantly to their workload and they cannot allow for all of the eventualities that might apply with regard to works insurance. It is far to complicated and they do not have the time.
I suggest that your friend names his girlfriend. The police will check the photos/video "match" the face of the driver and in all likelihood will leave it at that. Your friend's girlfriend will then get her form through the post - which doesn't include a requirement to produce documents - and once she sends it off (providing she has a full licence, has fewer than 8 points and the speed was within the threshold for fixed penalty or even a speed awareness course) that will be the end of it.
Honesty is most certainly the best policy here. If he tries to take the points for himself his lie is likely to be exposed by the photos/video at which point he'll be in the cart. The police will then get stuck into the case and the reason for the lie will undoubtedly be uncovered. That would see both him and and his girlfriend in court and his picking up a 6 month term - which is par for the course I'm afraid.My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).
