Credit file

Hi all, I hope someone can give me some advice.

Many years ago(10yrs) I had no choice but to enter a DMP. This was not an easy choice but I did not want a bankruptcy in my name. My thinking I borrowed the finance I should pay it back. Since then I have kept to my payments and in some cases most lenders are paid.

I have recently checked my credit rating after I was declined credit and found that CL Finance are still showing a default account after all these years and yet despite all payments agreed and on time are shown as late.

Can they continue to do this until the entire dept is paid off.

Also can I claim any PPI on any of the loans / credit cards I took out as I'm a little unsure.

    ICO guidance says "Accounts should normally be filed as being in default where those payments due have not been received for six months."

    If you're on a DMP and paying less than the minimum payment each month, then they should have defaulted you after 6 months. They can't just report late payments for 10 years. You need to make a complaint to CL Finance and then take it to the ombudsman if they refuse to remove the markers.

    You say they're showing a "default account" - what is the default date?

    You can reclaim PPI if it was missold, so for example, if they said it was mandatory or they sold it to you even when it wasn't suitable in your circumstances.

    As asked, what was the default date?

    Sometimes defaults on DMPs are issued just before balance is paid off, I suspect to maximise damage to the individual. Totally unfair. Read the ICO default guidelines sticky for reasoning.

    After reading the report properly the account has not been entered into default even though its been under a DMP. Can they do this ? Or do I have any rights?

    What are they actually reporting to your credit file, missed payments? An arrangement to pay?

    If youre not sure, could you post a screenshot of the relevant part of your credit report but make sure you remove all personal details before posting.

    Thank all, since a long chat with CL FINANCE they have had this removed from my file and today my rating has shot up by 500pts. It's amazing how much damage that they were causing.onwards and upwards.

    There isn't actually a specific marker a creditor can put on someone's credit file to say they are in a DMP.

    They can report:

    Arrears
    Defaulted
    Arrangement to pay

    That's it. An AP marker doesn't state the debtor is in a DMP, it just means they've negotiated reduced repayments with the lender that the lender has agreed with.
