Does your partner have proof that he paid for the laptop? A receipt or some form of written confirmation saying who he got it from and that he paid for it? If he does, then once the investigations are complete the laptop will probably be returned to him.

Nope. If it was stolen from Apple, it still belongs to Apple, even if the OP has the proof/receipt of "purchase" from the thief or someone who "bought" the laptop from the thief.

I'm curious how Apple have taken all this time to decide it was stolen. If the OP is to be believed, the device has been in to the Apple store on more than one occasion since the OP's partner acquired it 2 years ago, so why NOW is it deemed "stolen"?

Strictly speaking if there was an insurance payout then the laptop will now belong to the insurer.

Perhaps previously the employee hadn't been into the part of the system where the owner details were, or they had noted it last time after he left and were waiting for him to return?

Either way, if they can prove it's theirs your partner is stuffed. What makes you think he can keep the laptop if it was stolen from Apple? It's their property.
