UKCPS - Parking Charge Notice HELP PLEASE

Options
Hi really needing some advice my husband parked his car in the carpark next to his work for which his employer has given him a permit however this had fallen off his windscreen after he had left his car and upon returning to his car he has been issued with a parking notice charge of £100 and reduced to £60 if paid with first 14 days, he wrote back to them trying to ask them if they could let us off this time as it was on display when left car and it was only when he returning it wasn't which now realise from reading on here this was a mistake as he has now admitted to been the driver and that it wasn't on display. we have now had letter back from them saying our appeal has not been successful (no surprise there) and wondering if we can do anything else or if we are going to have to try and pay this fine, Please someone help this is really stressing me out as we cannot afford this kind of money :(

Okay a mistake admitting he was the driver, but don't worry about that. Is this in England or Wales ? And have they given a popla code to appeal to them?

    No they put the following:

UKCPS can only address the factual issues of where and how you parked. We will not enter into discussions about the legality of parking on private land or of the landowners right to impose parking conditions on their property. We have considered everything stated in your correspondence but it does not contain grounds to uphold your appeal. If you wish to make further representation, with additional evidence, please provide this within seven days of this letter. Second appeals must contain additional reasons not contained within your initial representation which you wish us to consider. You may also appeal to an independent assessor through POPLA (Parking on Private Land Appeals) details of which will be sent at the appropriate time if requested.

    Dear Peter Haswell

Thank you for your letter, the driver has given you mitigating circumstances for the challenge to you, the driver doesn't believe the signs were compliant as they were not at the location the driver parked at.

If you again reject this, please provide the popla code to appeal to them, under the BPA Code of Practice you must provide this on rejection, you can't pick and choose what is an appeal or not, you have 35 days from the original appeal to furnish the driver with this code.

If you do not, it will mean that the challenge to you will be accepted. And any appeal will be fully defended with a pepipoo defence, we know it will win, so the suggestion is to accept this challenge or pay £27 +vat and it will be won there.

They are out of order here. Have a look at this appeal I suggested in this thread post#8 https://forums.moneysavingexpert.com/discussion/4720779

The second half could be adapted for your letter telling them that they have no option but to supply a POPLA code and failure to do so will result in complaints to BPA POPLA and DVLA.

You will not correspond further unless you have a POPLA code and look forward to discussing the matter I front of a judge if they refuse.

Edit. I like stroma's letter too.

there are no signs at the entrance to the Car park anyway there is a sign near the pay and display machine which driver didn't see as due to having permit doesn't buy a ticket and one small sign half way up a wall which you would only be able to read if close up. we only now know these are there due to the fact the husband has been back on taken photos

Use stroma's letter in that case.
