in debt but moving abroad

in a nut shell - I owe several thousands pounds on credit cards accumulated over the last 7 or 8 years. I cant make any progress with it.
Its approx £15000 in total.

I have recently got dual citizenship and have been looking for jobs in Canada, Toronto.

If I got a job there and basically decided to up and leave this hell hole (the uk) would Barclaycard be able to do anything to make me pay them back?

What I would do is maybe give them a token payment of £100 a month to keep things ticking over but my minimum payments are more like £350 a month at the moment.

I read online that if I'm living outside the UK they cant legally apply for a CCJ against me.


Also I heard that going bankrupt could be an option and it wouldn't affect my credit file in Canada



Please don't judge me, just tell me where I stand legally. thanks

    The simple legal answer is yes they can get a CCJ against you whilst you are overseas and there is a procedure by which this could be enforced in Canada.

    But other posters will have more practical knowledge about what they could/would do in practice (if anything).

    Canada is one of the countries the UK has an agreement with, so in this case, any company you have any debts with could come after you in Canada.

    I've heard that if they know I'm abroad and they get a ccj I can have it set aside if I return to the UK as they can only register for ccj if I currently reside in uk

    £15,000 is not a small amount of money, I had a mobile network pursue me for 8 years over the sum of £150, which they eventually agreed I didn't even owe them in the first place - so to think a financial institution will drop a £15k debt just because you move to Canada is pretty naive.

    Needless to say, your credit rating in this country will be dust and CCJs will be issued against you at your last known address. It also appears that in a last ditch attempt the creditor will sell the debt onto a Canadian debt collection agency who will then pursue the debt in-country.

    You can try and cut and run and you might get away with it, but you'd be foolish to think a move to Canada will wipe the slate clean - you need to try somewhere like Cuba for that!

    Finally, remember that when you move to Canada it will be EXTREMELY difficult to get any sort of credit, or even a bank account in some cases. Friends of mine who have emigrated have been dependent on their UK banking assets for quite a while after moving because they can't get by otherwise. Need to buy a car, get finance on furniture etc. it will be no-way from the Canadian lender until you have significant time in the country, so your only option is UK credit.

    Anyway, obviously no one will think moving to Canada to escape your debts and overpayment of benefits is a noble thing but I doubt the OP cares about this.

    You can have a CCJ raised against you if you are out of the country, although I doubt your creditors will be aware of this as I'm guessing you wont be informing them of your plans to move to Canada.

    If you ever return to the Uk - even after 6 years any CCJ is still enforceable and if you get caught up with you can expect debt collectors and all the joys associated with that.

    In Canada you would be starting from scratch. Like you are an 18 year old with no credit record. Which by the sounds of it is a lot better position than you are in here in the UK. :-)

    What has saintly living got to do with this?

    Anyone can make mistakes and get themselves into debt - I did it myself while I was at uni and I'm more than happy to offer what advice I can to help people willing to deal with their problems. But when someone comes along with (apparently) no intention of paying something off it really boils my !!!!.

    There are so many people working hard to pay off what they owe responsibly so why should this guy be any different. The purpose of this forum is to help people save money and get themselves out of financial difficulty - not to give them advice on how to avoid paying.
