Leave it to the insurance to sort out, and take the hit on your premiums.
Filtering past stationary traffic is one of the most risky things that you can do, compounded by a clear road on the other side.
Pedestrians will simply walk between the stationary cars, and not even look in your direction.
Cars will decide to either pull a U turn, or cut into a sideroad on the right to bypass the queue, both activities without indicating or looking behind.
Cars will emerge from a junction on the left, and turn to their right, (towards you) without even looking in your direction.
(Yes I have experienced all of these on a regular basis)
Far less risky filtering between moving traffic, although they can still move out as you pass to swat you off the bike.
Save your money on the solicitor, if you must, go to an ambulance chaser, they (like your "legal cover") will only act if they are 100% sure they will win, and I like some other poster reckon you might get 50:50.I want to go back to The Olden Days, when every single thing that I can think of was better.....

doesnt the highway code state that if you are on a scooter or motorbike you must drive in single line behind traffic, so if there is a queue of stationary cars, you should remain stationary behind it.. if the driver has pulled out in good faith knowing this to be the case i think the outcome of this would be more likely 50/500

No, the Highway Code says if you are filtering then you should do so carefully and at low speed0
