Help! worried i could lose my house

My husband recently lost his job and the DWP have notified him that he is not eligable for JSA. Our mortgage protection policy with Aviva has stipulated that in order to process our application we need to - along with other documented evidence, provide a decision letter from DWP. This arrived today 27th July with the start of his claim made on the 30th May. The decision letter has said he is not entitled to JSA as I earn around £200 a week. Does anyone who may have been in a similar situation know if mortgage protection policy will still pay out based on the decision made by DWP. Please help. Thank you

He needs to make a 'credits only' claim for JSA, so in effect he will sign on for his NI Credits, but will not receive any payment.

(I am assuming the decision not to award conts based JSA is correct - has he been in regular employment over the past few years?)
  • Thanks for replying. He has been self employed for the last 3 years and is in arrears with NI contributions for 2011/12 and 2012/13. He received last week his final NI bill for that period. if this was paid now would it impact on the DWPs decision? My main concern is if mortgage protection will pay out based on the DWPs current decision..

Self employed conts do not count for JSA.

He should not have a problem claiming on his MPPI whilst on a credits only claim - it is one of the main reasons people continue to sign on when not receiving any payment.
  • Thank you! Dave i will contact our team monday, i was just seeking assurance as monday seem a long way away today.

I wish to know why tmpp is sold but it is not made clear on policy summary documents at time of sale that to claim on the policy you must be in receipt of jobseekers allowance.
As contributions based jobseekers allowance only lasts six months you can only benefit for six months on a policy that states it pays for 12 months if unemployed.
I say this as someone who was made redundant and did not claim jsa but tried hard to find work and did so funding myself in the meantime with my redundancy.
Why at time of signing for the policy can this not be made clear as funds may preclude some from claiming for the full 12 months if still unemployed? this way you know what you are getting.

Does the policy actually require that the policy holder would need to actually receive Jobseekers Allowance?

Why should a "summary" have to include that particular statement (if it is the case) if it is clearly stated in the document? People are meant to read the document, not just the summary.

sorry I have not made myself clear when in the bank taking a mortgage the full policy document is not provided only s summary stating that in the event you become unemployed they will pay for 12 months not that once registered as unemployed. I also would like to know how it affects the end of the period for claiming contributions based jsa ends and not eligible for the regular jsa for means test reasons.
I guess what I am saying is that the way the summary is worded led me to feel I was protected and meant that when the policy booklet arrived further down the line I didn't feel a need to read it because it was all sorted and before you say it yes stupid me.

You have changed the requirement from "receiving JSA" to "registered as unemployed".

Whilst to be receiving JSA you need to have registered as unemployed, being registered as unemployed does not mean that one receives JSA.

So if someone has not found work in the full six months that contribution based JSA is paid and they do not qualify for income based JSA they can still register as unemployed.

That means that the policy would still pay out for the final six months of the year as long as it is about registration, not JSA.

Thank you so much for the reply, all is clear it is possible to register as unemployed but not receive JSA.
I wish I had known this 18 months ago, but I guess you live and learn.
    Thanks for your help.
