You can reject it up to the point you actually eat it.
So I would have sent it back and left.Really?? So if I ordered everything from a menu and then rejected it all when it came out I would be entitled to a full refund? The restaurant couldn't even claim the expense incurred by them due to my actions?
I doubt this is right.
Don't take it out of context! It's quite clear the comment is based on op ordering one thing and receiving another!0 -

If you don't eat it then you would have a strong case, if you do then you have no case.0 -
Absolute nonsense, once the item is ordered, like any other product the contract is entered into, eaten or not. When faced with a problem you must still pay under protest and fight it later, anything else is theft.
If you don't eat it then you would have a strong case, if you do then you have no case.
Kind of - but not quite
If you order something with no intention of paying then it is fraud
If you order something and it turns out not to be nice then you can refuse to pay as the service hasnt been provided properly.
If you eat it all and refunse to pay then you will have a hard time arguing you thought the service wasn't provided properly and will given the Police ammunition to arrest you for fraud.0 -

Your OH should have corrected the 'penne' comment from the cashier and said 'Panini' - would that have been so hard to do?
Face it, your OH didn't know the difference between a Panini and a penne - plus what he paid was more than the menu price for a Panini... how is that the restaurant's error?
If you want to look like a couple of hicks who don't know the difference between a pasta and a bread roll then go ahead... I'm sure the restaurant will be only to willing to point out who was at fault!
Gee thanks .
I think it's the staff who can't tell the difference.Decluttering, 20 mins / day Jan 2024 2/20 -
I think they're taking the penne...0

The easiest option for the OP to get justice it to trash the restaurant's reputation on the Trip Advisor, telling the true story there. It is not worth fighting for £8, but worth making the place lose a couple of customers...0
