LCS harassment

Dear MSE:

I have received a lot of letters from LCS. And the tenancy agreement of the flat is under one of my friend's name, i lived there for roughly 2 months, at the end of the tenancy my friend needed to go back to the States for some family issues. So I was doing my friend a favor by calling EDF at the end of tenancy and tried to pay for the bill. And EDF claim not able to track down the flat number hence they have no record of the bills. i left the landlord my contact address to redirect mails.
As I moved into the house I bought, LCS sent me a huge bill of £1800 to claim the EDF bill, I was ignoring them at first, and then they sent me the HUGE EDF bill with my name on it. and threaten me to pay if not they will take legal actions.
And i reply by telling them, i only lived there for 2 months, and only was doing my friend a favor for asking them the bill, and now my friend has lost contact with me, therefore I cannot do anything about the bill apart from paying the 2 months of the bill.
They said they could offer me a 10% discount.
I didn;t know what to do so i ignored the letter, and the next day they became very aggressive and said they will proceed legal action today, also told me although i lived there for 2 months, but under some consumer act law, i m the person that is liable of paying the whole bill.

What should I do??

  • First and foremost I would ask for a copy of the EDF bill to come through to yourself.

    Then I would look at the tenancy agreement for the premises that you were at and see if your name on it or if it is just the name of your friend.

    If it is just the name of your friend then as far as I am aware then it would be your friend that would be liable for the bill.

    If your name went on the tenancy agreement from the start then you do have liability for the bill but if your name only went on the agreement 2 months ago then you will responsible for the bill for that time period.

    That is how I would interpret this situation.

    Hmmm - It seems that the friend who's returned to the USA wasn't quite the friend you thought they were.

    So far as you are concerned, the key to the problem is you being able to prove
    to EDF that you only lived in the flat for the final two months of it's lease,
    for this you need the paperwork showing where you were living before - Rental Agreement/Council Tax Bill/Utility Bill ?

    It's always easy for the fly-tipper, it takes them five minutes to create a mess, but days for the people sorting it out.

    If you expect to "ignore" your way out of this, you need some more lessons from your "friend".

    The people in EDF and LCS are just people sitting in front of computers. You have to find an address and patsy for them to chase. Your friend set you up as the patsy. This means you are the victim who has to climb your way out of this mess.

    People like that should be strung up by the you know what, and be dunked in poo hourly.

    As mentioned, prove that you were only in the property for the final 2 months of the tenancy.

    Whether your name is on the tenancy or not doesn't really matter - you don't dispute that you did live there & therefore can be chased for the bill for the time that you lived there.

    As already advised above if you can prove the period you lived there then anything else outisdie of that is EDFS problem and not yours.

    Threats of taking you to Court for the entire balance are likely to be nothing more than hot air & an attempt to frighten you into paying something that you don't owe as unless they can prove you did in fact live there longer they wont win by going down that route
