Advice urgently needed

I live in Scotland and last year was fortunate to be able to buy a new build, which was discounted by the Scottish Government. All was well apart from the usual new build niggles. At xmas the flats were flooded by the small burn that runs along side it. Although being on the first floor i was not affected as such but 5 groundfloor properties were. At a recent meeting with the factors, insurers and local planning dept, we were informed that :

There had been no flood risk survey done as it had never flooded before.

The only drain from the flats goes directly into the burn!!!!!

The developers/builders say they followed code and is no longer
their concern.

The insurers say even if we apply all the reccomendations, they cannot be sure the insurance wont rise significantly.

What it means is the Government gave money to the developers to build flats to sell to people who would not normally get on the housing ladder, who in turn now find themselves in properties they may not get insurance for, or be able to sell. Any advice would be most welcome. Thank you.
