CMS parking ticket whilst getting change for pay & display

Hi I'm new here and losing my nerve in holding out on paying a 'parking charge notice' I recieved from CMS at Lythan St. Annes pier. I got a ticket when unloading the car and getting change for the pay and display machine. I returned to my car, pay and display ticket in hand only to find the attendant just leaving the parking ticket on the windscreen. He was a bit clueless and said it was too late, he'd already written it but to appeal as the time he'd written it and the time on my ticket were only 4 minutes apart. I also spoke to the pier office and they shouted over to him "you're a bit keen this morning aren't you?" I appealed the notice in writing the very next day, sending a photocopy of the whole days pay and display ticket that I had purchased and waited. Call me naive but I hoped to hear back. The 'fine' rises from £60 to £100 after today. Can I really just leave it?

    If you've appealed, which is looks like you have, you must wait to see what comes back from CMS. If they reject it, they must send you a POPLA reference code, at which point to appeal to POPLA and win with the right arguments.

    How long ago did you send in your appeal? They must acknowledge it within 14 days. Many PPCs seem to "suffer" from poor postal system, it's amazing how many postal appeals seem to get lost in the post. I do hope you got a certificate of posting.

    I'd say that this comes under the grace period as stipulated by The BPA Code. When I sent my appeal off, I done it by e-mail so I had an audit trail and an automatic reply from the PPC as receipt. Might be worth doing that if you have internet access.

    By the way it's not a fine or a ticket, but a request for monies. Only the Police and Council Appointed Wardens can issue fines.

    Oh calm down and get a grip, this isn't a short term appeal and won't be resolved yet.

    It's a fake PCN anyway, you will not be paying anything and they have 35 days to respond to your challenge. Then you get 28 days to send in your POPLA appeal (with our help of course, to make it a winner!). Then POPLA take about 3 months to make a decision so it may all be cancelled before Christmas.
