Employer refusing pay ssp

Hi I have been signed off work and my employer has said I do not qualify for SSP
my first date off sick was 8th July my lasts pay day before that was 5th July and average earnings for 8 weeks from 5th July is £875.74
which works out £109.43 a week
The problem is my employer has based it on what I earnt up to the 5th July ( we are paid a week in hand ) and by doing that I'm under the L E limit
Basically on the 5th I was paid £116 in to my bank which means I would qualify for SSP
But they say I earned £65 up to the 5th ( which actually got paid in to my bank account on the 12th ) any ideas anyone ?!?!

    They are right - it's what you earned in the period, not what you were paid.

    If your employer is saying that you are not entitled to SSP then you can claim Employment Support Allowance.

    Your employer will have to complete a form to say why you are not being paid. Presumably this will be checked so any errors will be picked up (hopefully!)

    If this is long term sickness then, if you are claiming any other benefits, you will need to inform them of the change of circumstances.
