Does ANPR recognition break law?

I read with interest this article on the BBC:

"The use of ANPR [automatic number plate recognition] cameras and other forms of surveillance must be proportionate to the problem it is trying to address."

If its disproportionate for the police to use ANPR, then PPCs looking to use ANPR for civil suits is even more so?

Or would it be different because its on private property? I would imagine they still have certain responsibilities with the ICO where dealing with the general public in a retail business.... (but I'm totally guessing and completely uninformed)

  • The legislation only applies to public bodies under the Regulation of Investigatory Powers Act 2000 (RIPA).

    These lot aren't classed as public bodies.

    I also very much doubt that PPC "ANPR" is anything like the generally accepted implementation of the concept/technology.
