Mobile phone insurance

We have just realised my husband has been paying out three lots of mobile insurance to phones 4u since 2001 and he hasn't had a contract with them since 2003 and they never cancelled the payments. Can we claim this back as he never wanted the insurance to start with.

did he cancel the contract in writing with them and does he have a copy of the letter.
These are minimum term contracts and may still be in force.Be happy...;)0 -

They don't cancel the payments, he cancels the payments.
If it's direct debit insurance, they don't know he hasn't got the phone, only he knows that. I imagine it's entirely separate form his phone contract with them?
If that's the case, he can ask, very nicely, that they refund him, but as the onus is on him, they don't have to, hence asking very nicely.Non me fac calcitrare tuum culi0 -
Thanks. He took it out when he was 18 and mobiles etc were all still quite new. When he changed the phone after a year and cańelled contract he assumed insurance was cancelled along with it and took new policy as company didn't tell him it was all separate at the time and they didn't see he already had insurance with them. As I say I understand onus is on him now but I don't think that was made clear 11 years ago to a naive 18 year old.0

Well, he will have to write and serve notice of cancellation of his contract.
Or it might be better if you do it for him.
Write a letter, get him to sign it and obtain a certificate of postage.Be happy...;)0 -

Its easy to be critical but what is done is done.
Write a letter explaining the position. Explain he failed to notice, thought he had cancelled when the phone contract was cancelled etc and ask very nicely if they would refund all or some of his payments as a goodwill gesture.
Its unlikely they will agree, particularly if they have been paying another organisation to provide the insurance.
Has the price gone up over the years? If so they must have written to him to tell him?Few people are capable of expressing with equanimity opinions which differ from the prejudices of their social environment. Most people are incapable of forming such opinions.0
