I too received a parking charge at Humberside :j. Literally stopped for 20 seconds, husband got out, I drove off.
However it states the contravention was on the 16th July and the photo's show the 17th!
Any leg to stand on????

POFA 2012 Schedule 4 concerns parking, and my vehicle didn't park, it merely stopped to allow passengers to alight. POFA 2012 Schedule 4 also doesn't apply on roads covered by statutory regulation, which means most private airport roads (they are subject to byelaws).

Yeah, but by the code of practice from BPA they HAVE to provide a PoPLA code if an appeal is rejected. Any Court 99% of the time will support arbitration and litigation is a last resort.Search my post " PoPLA evidence - What to submit" on what is a good defense for a PoPLA appeal.0 -
Not so. VCS are members of BPA Ltd & as must offer a second level of appeal to the "independent" body POPLA whether they rely on POFA to pursue the vehicle keeper. Some PPCs still go 'old school' pursuing the driver especially if the DVLA is slow in selling the driver details.
I was responding to the theory that bazster put forward that this is not a Parking offence and not covered by POFA.
Personally, I see where bazster is coming from and strictly this is not parking. But as I said in a previous thread, I believe we should be pragmatic and appeal to POPLA as if it was a parking case.
Particularly as if the PPC uses road markings (double yellows) that DO allow stopping this is bound to confuse drivers, as their chief adjudicator conceded.0 -

Hi again
I now have had my appeal rejected (as expected) and have the POPLA form, I now need to build a defence for "stopping", a little help in what sort of things to put in would be welcomed.
At the minute all I can come up with is that because there was no financial loss (bus stop) then the charges are excessive.
The signage is Parallel to the road, so you have to stop to read it.
Any help on anything else I could use in defence would be most welcome.

As well as the couple of points you've put above, those listed by bazster in post #6 are a good starting point - and you're well on your way. Then have a good read of the sticky at the top of the forum board 'POPLA Decisions'. Also this link from Pepipoo which lists loads of POPLA decisions:

The most recent POPLA wins have heavily featured the 'pre-estimate of loss' and 'contract with landowner' angles, so you should be able to extract plenty of strong points from those.
Don't be afraid to copy and paste from these appeals, although try to work them into your own style of writing, and do make sure you try to understand the actual point you are putting forward, rather than blindly copying any old paragraph and pasting together with a load of others.
Once you've had a first stab at your draft, post it up here and we'll help you fine-tune it.
But don't take your eye off the ball - you've got 28 days to get this to POPLA; miss the deadline and you're then into a whole barrow-load of fun from the PPC, debt collectors and quasi-solicitors.Please note, we are not a legal advice forum.
