Your ex should be paying maintenance for the children at the very least.

i don't think your advice is very well thought out and IMO not exactly true to life - the ex husband now has his own place and the bills that go with it, depending on how often he sees his kids, he may not require to pay anything. he certainly should not be shirking his parental responsibilities - but taking his money is not the answer. If the OP does as you suggest...................

the ex-husband should demand that the "family" house is sold, he can make a £40k profit and pay off his own debt, THEN he can pay maintenance for the kids!

its not always as straight forward as it seems - but i do think you should seek some very good financial and legal advice

    good luck
  • Hi,

Just thought I'd update this thread and tell other worried people the outcome of my story.
My situation got worse before I had much of a chance to do anything about the debt, as my partner and I split up. He moved out, leaving me struggling with our entire debt, and has not paid a penny since. Another story!
However, I had taken the very down to earth and realistic advice of Dave Ham, and sought professional advice regarding getting the mortgage transferred into my sole name, and getting enough money to pay all of the debt from the equity locked up in the house. In the end, I chose to go with Dave Ham's company, despite it being the other end of the country, and I could not have been happier with the service. This may not be the place to recommend brokers but....
I had previously tried to remortgage on my own with my present lender, but they had refused on the grounds of my income and credit commitments. Without a broker, I know I could not have remortgaged by myself. Luckily, My nearly ex husband ( I am now actually getting divorced) agreed to transfer the whole of the equity in our house into my sole name. I am not going to chase him for maintenance. This has worked out for us, as I can afford, minus the debts, to bring up the girls by myself. He will continue to help out when he can.
Dave Ham managed to get me a brilliant deal for a 2 year fixed mortgage with a high street lender. I know its not the MSE way, and I will be paying for the debt over a fair few years now, but there literally was no other way. Especially since my partner left, my outgoings, despite being extremely frugal, were much more than my income.
So, I know I was in the lucky position of having the equity there in my house, and many people won't have that option, but for those that have that possibility, even though you might think there is no chance of remortgaging, get yourself a good broker - they're worth their weight in gold
