Post IVA issues with First Plus

I have searched the forum and not found and answer but was wondering if anyone could advise me on this issue.

In March 2007 I started an IVA and this completed Last March. Its now been over one year since I completed it and my credit file on Experian is getting better by the day as the defaults are dropping off. Its a shame that they all could not have updated in March but then you have to allow for administration I suppose. (And for the time it will take I don't see the point in all the ringing around)

However, I have an issue with First Plus they for some reason have placed a late payment marker on my file on the 04/04/2011 (I think when they sold the debt) and although this is showing as settled its still an issue. They were apart of my IVA in March 2007. I have spoken to them directly and am awaiting a call back but they are suggesting to me that they will not remove it as they need to show a true representation of my credit history. Surly this can not be right, I put my hands up (and was probably ill advised) and entered an IVA in March 2007 knowing that I could rebuild my life (ie Mortgage) in 2013. But now because of First Plus this blemish will stay with me until 2017. For a start its not factually correct. Who can I contact about this or can I do anything about it?

Any advice truly welcome...

I agree it is not an accurate reflection and should address it

So this account was part of your IVA?

    If so then.....

    - Inclusion in an IVA is a clear indication of a default.
    - To record it as anything else would be an inaccurate representation of the account status and history.
    - Any creditor once informed of the IVA should record a default.
    - This should be backdated to the start date of the IVA.

See paragraph 46 and 47 of the ICO guidance here: https://forums.moneysavingexpert.com/discussion/3172602

As said, make a formal complaint stating that you will take it to BOTH the ICO and Financial Ombudsman Service if not corrected.

Important to mention and do both, as at the moment you are maybe more likely to get movement/result via the FOS. Plus referring to the FOS would cost 1st Plus £550 in case fees, which if they have any sense they will want to avoid. ;)

Very good. Check that they do.

If they date the default as March 2007 as they should, then everything about this account, the default, payment history, EVERYTHING should disappear from your credit report leaving no trace of the account. :D
