options when payment unclaimed

Hi, what are my options if the seller simply does not claim the payment, am I just forced to cancel? I can't open an INR as I haven't paid and if I cancel can they open a NPB?
I have paid for an item through paypal but payment is pending, showing unclaimed. I have had this before and it was because the seller had not updated paypal with their email address, it was quickly resolved.
Usually I would just cancel but it is a rare item that I have been looking out for, not too valuable but I got a great bargain and I think the seller doesn't want to sell or will lose out by the time they pay p&p. I have messaged seller who has taken 2 days to reply to each email promising to look into it and get back to me.

Depends on what has happened. Usually in these cases, the email address is wrong or not linked to Paypal in the sellers listing.
It can only be resolved by the seller though. If he can add the 'wrong' email to his Paypal account he should be able to claim the money. If he cant, the only way is for him (or you) is to pay an invoice for 'goods' through Paypal.

Log into Paypal and see if the transaction says unclaimed and if gives you the option to cancel the payment. Not much else you can do at this stage.

Thanks, the seller is now ignoring my emails, it has been almost 2 weeks since the auction ended, they answered the first 3 and have now gone quiet. I have also searched the ebay boards and there isn't much info there either. I do have the option to cancel, the status is unclaimed, I did not know that I could ask them to send a gift invoice.
I have checked your link and my address is confirmed I am not paying by credit card and my other purchases have cleared straight away

I suspect you are correct. Not much you can do without the seller cooperating though.
You could report them for Seller Non-Performance and refuse any 'Cancellation Request' by them, but that's about it.
Cancel your payment, if you get a NPB strike, it should be removable if you enter the payment details showing you tried to pay.
If it comes to it.
Do not do a Paypal 'Gift' payment (for friends and family), you would have no protection. There is another tab Buy>Make A Payment, that would be the one you would use (but you would need their correct Paypal address). Or they would use Sell>Request A Payment.

Tell the seller that you will leave negative feedback if you don't receive the item within a certain timeframe. You can also report the seller:

If they opened an unpaid item case you could simply pay again and it would close in your favour. It seems unlikely they would (manually) open such a case, which requests payment, if they don't want to sell the item. Alternatively, if you didn't re-pay and got a strike you could appeal to eBay to attempt to have the strike removed, showing the evidence that you paid initially but that the seller didn't claim the payment and stopped replying to you.0 -

Threatening feedback. What will that do? Probably get the sellers back up and ensure no item is ever sent.

As the payment isnt claimed, then the payment hasnt been made as far as NPB is concerned.
So the buyer threatens negative feedback or even leaves it. The seller opens a NPB, the buyer cannot pay (or did you think opening a NPB would somehow reset the paypal details on the listing?). The seller closes the NPB. The feedback is automatically removed.
Yes the buyer can get a strike removed but they have had their feedback removed. So why threaten to leave it?
Why not act like an adult and try again to contact the seller. Use advanced details to get a telephone number if you can or send one last email (they could be on holiday).0 -

It's much fairer to warn the seller of the risk of negative feedback than to simply leave it (which most people would consider appropriate if the transaction is not ultimately fulfilled as a result of the buyer's suspicions proving correct - the seller ceasing contact and not wishing to send the item).

Qualification? Sorry, I didn't realise it was a competition, is 6 figure selling feedback enough? TRS, Titanium PS? Anymore? Oh, account manager on there and Paypal?? Well you did ask.
And back on topic and not petty point scoring. You didn't read what I said.
Leaving negative feedback is pointless as the NPB process will not realise the buyer has paid. So the feedback will be removed if the NPB process is started, despite what the 'help pages' say.
But if you were a BIG seller, you would know that already.
