    All if these companies are fighting for license by the FCA which means they are not going to ask you to increase if you can't afford it.

    If the cost of living has gone up, send them a copy of it. If they ask you to increase, and you feel you can't.. Say no!

    There is nothing forcing you to increase and unless your figures are higher than the Common Financial Statement trigger figures they would have difficulty taking you to court.

    Stand up for yourself but there is no point sitting and ignoring them and trying to get one over. You don't have to agree to demands but be reasonable and you might be surprised!

    I wish I had the benefit of your experience.

    Mine is 180° opposed to yours. They will grab any excuse they can get to screw you for another increase. Common financial statement, reliable payment history, affordability or legal entitlement doesn't make any difference.

    Send them a CCA request, see below :

  • I don't disagree with the suggestion to send a CCA request as the debt is that old.

    But to answer the original question, no you don't have to send an I&E, but then they don't have to freeze interest and they can go to court for a CCJ... So sending them an I&E which shows you are paying them what you can afford is a sensible move.

    thanks for your replies but this query was from last year 2013

    they replied saying they would accept what was previously paying .
    . ..i ended up offering them a F&F which they accepted so one less to worry about
