Vendors Card Payment Charges

A few months back the BBC reported that the OFT had looked into card charges for using credit and debit cards to pay.
The result was supposed to be vendors not charging any more than 50p to pay by a debit card and no more than 2.5% of the transaction for a credit card.
Has this come into effect and what happens if places are still charging too high a fee.
Recently I refused to pay a £4 charge on £35 hotel room.
Plus.net charged me £1.50 for paying by card on a £17 bill - I switched banks and apparently the DD didn't move over at the right time of the month (?)
Plus other questionable charges.

I thought it was that they were not allowed to charge more than it cost to process the transaction, rather than a fixed fee.
If a company charges an excessive amount you can make a claim against that company for a refund of the excessive amount, unless that company is a new company or a micro-company, in which case the rules don't apply until June 2014.0
