Where do I stand?

I bought my girlfriend a camera for her birthday, October 2012, from Amazon.
It was a waterproof camera for our Holiday to Florida June 2013 and had very little use before our Holiday. It is supposed to be waterproof up to 5metres.
The first time the camera was used in water was whilst snorkeling on our holiday (it was taken no more than 1metre deep). The camera worked perfectly fine and my girlfriend did all the relevant checks (in accordance with the user guide) before taking it into the water. That evening the camera would not work and would not work for the remainder of our holiday.
I have sent an email to the seller through amazon and they have offered to repair it under the 1 year warranty. However I'm unhappy to have a faulty camera repaired if it broke after the first use in water. Am I within my rights to ask for a new camera?

    You can ask.

    They can however repair, replace or refund.

    You have a right to a repair, replacement or a refund.

    But it is at the retailers discretion I'm afraid. They woud normally choose the cheapest option, which is repair.
    make the most of it, we are only here for the weekend.
    and we will never, ever return.
  • Part of the problem is that the camera was 9 months old when it was first tested in water. If you had tested it when you bought it, even in the bath tub, you might have had more chance of a refund/replacement.

    They can legally also ask you to prove to fault is inherent after 6 months
