hi,
i need some advice,, i am in a civil partnership but we have been "seperated for a few months, we still have to live in the same flat as we cannot afford to move anywhere seperately. i have just, for the first time in my life applied for jobseekers allowance, as i am out of work. i have been told that i cannot get any as it is contribution based and i havent paid enough class 2 (i am self employed) i have massive debts (nearly 80,000) over 15 years this has partly caused the seperation.
my partner works but only pays half the rent and the council tax . everything else i have to find on my own, because he works the contributions office will not pay me benefit , when infact i have NOTHING coming in the pay my half of the rent or council tax, even food
will be grateful for any advice i suppose we should legally divorce but i am guessing that would look susoicious. even though it is genuine. it seems if we live seperately , i would get housing benefit, and the jobdseekers allowance.

yes it would definitely be better to live separately.
but theres another forum on here that might advise you about your debts0 -
Have you taken any legal steps to divorce?
Is the property one or two bedrooms?
Can you demonstrate to the Local Authority that you are living separate lives - you will need to convince them that you are separated to try and claim help towards your half of the rent and council tax. These are my own views and you should seek advice from your local Benefits Department or CAB.0 -
we are living seperate lives as best we can i a one bedroom flat. the costs of separating are high so it has been a necessity. how can you proove that you live separate lives, he sleeps on the sofa, i sleep at my parents from time to time0

ps i cannot move to my parents permanently because of my debts, i dont want them to move with my as i am thinking of filing for bankruptcy, i would not do that at my parents address to taint them0

You can't prove it. Normal steps are to divorce and move out, you'd be hard presses to convince anyone you are not trying to gain extra benefits and remain a couple.
They are working so surely instead of them sofa sleeping they can move out.0 -
Unlikely you will be treated as separated if it is a one bedroom property. These are my own views and you should seek advice from your local Benefits Department or CAB.0

Hi
Moving to live with your parents will NOT taint them if you go BR.
Credit records are attached to people not addresses; and have been since the age of majority was reduced to 18 years as the powers realised that slack teens were wrecking the credit ratings of responsible parents.
Please go over to the BR forum and take advice there ASAP.
When does the fixed term on the rent run out, as you are responsible until that comes to an end.If you've have not made a mistake, you've made nothing0 -
thanks the rent is not fixed term but ongoing. and i need to give a month notice0

Notice needs to be timed to arrive with the EA/LL (address for serving of notices) before the end of the tenancy period SO if the rent date is 25th of the month the notice has to be sent to arrive today.
Your ex needs to talk to the LL as when yoiu serve notice it ends the tenancy for both of you (assumng a joint tenancy) and your ex needs to make their own new arrangement. If you've have not made a mistake, you've made nothing0
