Advice on Incapacity Benifit.

Hi All,
Just wondering if anyone had any advice to help out my father?
He has been made to retire from work on medical grounds, his company have a scheme that pays him 75% of his annual wage, and he has also been advised to claim for incapacity benifit.
The problem is, that the insurance company pay him 75% of his annual salary minus the state benifit ammount (£80ish) and tell him to claim it back through incapacity benifit.
But when he tried claiming incapacity benifit, they said he was not intittled to it because he gets the money from his company scheme.
Therefore they are taking money from him and telling him to claim it back from the state but the state says he's not entilttled to it.
The insurance company will not talk to him because he is not the policy holder, his company don't know any answers either. He is being told by the insurance he can claim from the state but the state say he cant because he gets the insurance.
Any advice would be great.

I haven't got any advice on your situation.
Could your Dad go to the citizen advice they will be able to advise your dad on what to do. Good luck!!

The Human Resources dept., in his firm should know the answers, or at least find them out.
Many people claim IB on top of any occupational pension - although it can be affected by any OP amount over £85.
But, as the previous poster says, the best thing to do is to get some advice from the CAB.

Devonmark- has your father made a claim to IB or has he been wrongly advised he wont get it so don't bother claiming? Was he off work before he was retired and if so for how long? Yes his OP will affect IB (to the best of my knowledge which is very limited as I only take new claims) How old is he if he or his partner (if he has one) is over 60 he maybe able to claim Pension Credits.0
