    He wont let my mum sublet it either. She is going to get hold of contract to see where she stands. She has got until september to sort it out or he gets it and she has to pay him:(

    I doubt she will keep the caravan, she is moving back to Wales in a few weeks not far from the site and wont need it.
    There is no upgrade rule onsite but he wont accept caravans over 15 years now.
    We think he already has a buyer for my mums plot (and possibly caravan) as she saw him showing someone outside.
    He says she has to give him the caravan with all fixtures and fittings as she bought it and just take her belongings. He wont even let them take decking area!
    Surely if she owns it then she can take it all???

    You need that contract. All the answers are in there.

    In theory, of course your Mum can pay the disconnection fee and move the caravan at her expense. But you just don't know what she agreed to in that contract.

    September isn't far off. If she can move it, you'll need to find and book somewhere to take it and book the transporting company. This takes time. You may even have to give x months notice to the site owner.

    If there is no contract there is no contract and the site owner refused to give her one, then she can do anything she likes.

    Unless she signed a leasehold agreement of some sort, his moves are very questionable.

    Maybe see how he proceeds in September, if he sells it on sue him for the current market value. Could work out much better than selling it herself :)
  • When you bought the Caravan you should have signed a licence agreement which sets out what he can do.

    He cannot force you to sell the Caravan to himself but he can charge commision, I think the limit is 15% but it might have changed.

    Everything inside the caravan you own, as you brought it. Outside if you brought the decking with the caravan then I would assume you can do what you want with it. I know on my site everything bar the concrete base is yours.

    Do you know the make/model of the Caravan as he should give you book price but at 15 years old the value would most probably be in the metal and fittings.
  • How about your whole family going on holiday in this caravan, sitting on the decking & telling everybody they can find just what a b*****d this bloke is? While you are there, you could ask him for a copy of the contract. And when you leave, just put the plug in the sink and leave the tap on full.

    Oooooops..... a ruined caravan!!

    Mum went to landowner to get a copy of contract, and now it turns out that there isnt one!!!! His wife says its a verbal agreement. All my mum has got is a copy of site rules which states that the landowner has to sell the caravans on (no mention of age of caravan)
    My mum and stepdad are now seeking legal advice.

    Yes it seems the law has changed too recently in their favour of selling it on.:D

    So good news all round :j
