Maybe if you could explain the access situation better.

You, I presume, live on the top floor. From which a communal corridor leads to your terrace?

There is a gate on the terrace, where does this lead to?

Strange things happen - some people won't use outside space. I used to live in an apartment with a gorgeous outlook over the river, docks, bridges and sea.

Out of nearly 100 flats, I was one of the very few who used the balcony.

Also, has anyone else from a lower floor flat ever used your terrace?

Yes I live on top floor - there is an outside corridor (American style - or at least that's what I call it!) which runs from the stairs and lift - to the 3 properties - the other 2 flats are on either end and ours is in the middle - with the terrace opposite. The gate leads from corridor straight onto terrace - it's right opposite our front door (can't connect as our flat is on other side). No one else has ever used it since moving in, in January - We've also got our own table chairs/ sun loungers up there!

Ah well - (my anger has subsided somewhat now!) looking on the bright side - maybe we'll meet some new friends!

Good neighbours are worth their weight in gold.

I live in a house converted to four flats (each of us has a floor). One is vacant, the neighbours in the other two flats are absolutely fantastic and I don't mind them using my garden (it is MINE, though). What miffed me was the agent advertising my garden as a selling point. I objected to that.

Maybe your new neighbour won't even use it - especially if there's stairs in between their apartment and yours.

UPDATE - I have just spoken with our landlord - who has told me that it is in fact PRIVATE! The AST was wrong (he hadn't checked either) - and that he owns the terrace - was purchased with the property and it is for our use only.

If I see another estate agent lurking I will tell them straight away!

Why not make a sign saying "Private - property of flat XX"? Or even putting a lock on the gate?

Assuming you're not at home 24/7 you won't see all the viewings, and you wouldn't want new neighbours to move in under the impression they can use your terrace...
Let's settle this like gentlemen: armed with heavy sticks
On a rotating plate, with spikes like Flash Gordon
And you're Peter Duncan; I gave you fair warning

Great idea - Thanks Benjus. We already have a (fairly ineffective) lock - I will make up a sign tonight....

Feeling very happy !:jOff to enjoy a nice glass of wine on my private terrace!
