MBNA upheld loan..name spelt wrong thou

Hi,
I have just had a letter saying my complaint has been upheld (MBNA Loan)
only problem is I notice they have spelt my first name incorrectly, does anyone know whether they use the full name when sending a cheque or whether they would just put Miss and surname?
Also....sorry to blab on, I have also had MBNA reject my complaint on a Virgin CC taken out in April 05, they have sent me a copy of the agreement saying I ticked a box for PPI, I have scoured the agreement with a fine tooth comb and cannot see a box for PPI where i have ticked? they said this is their final response, is it worth persuing with FOS? I have issues with PPI as I was made redundant in 04 and never claimed on any of these policies as I was not actually aware I had them so since then I have always said no to PPI as I never used it when I apparently could have so they were pointless for me. At the time of taking this CC I had only been in my job 2 months and i believe the PPI was added in a phone conversation(hard to prove-I know) I was told that my card couldn't be activated without it even thou i again stressed I did not want it? Hard one as like I say, how can I prove a telephone conversation!
Any advice would be greatly recieved

A majority of credit card PPI sales were post sale (typically over the phone). So, you woudlnt expect it on the agreement. That is why we dont normally tell people to bother with credit card agreements as they dont aid your complaint.they said this is their final response, is it worth persuing with FOS?
You havent said what your complaint reason is and what evidence you have to support it. So, we cant really comment on that.how can I prove a telephone conversation!
You cant. If the sales process of the card provider is compliant then the complaint is rejected by the FOS (assuming no other failings identified). If the sales process is deemed uncompliant then the complaint would be upheld.I am an Independent Financial Adviser (IFA). Thanks for your reply Dunstonh, much appreciated, what confused me was in their rejection letter they have stated I ticked the box on the agreement which was enclosed so I could see...like I say, I scoured it and cannot see a ticked box or any box related to PPI, agreement was signed 8th April 05, PPI applied 13th April 05. To be honest, my complaint is weak as I should have checked statements and paperwork more thoroughly, my complaint reason is I am sure I stated no to PPI in the phone conversation but I believe I was basically told it had to be applied to activate the card, too long ago to remember fully so I will accept their letter and hope the cheque for the loan I had with them will be bankable!

Your complaint is confusing. Either you ticked the box or you agreed to it over the phone.
If they can't prove you ticked a box in the agreement [is it the original or a reconstituted copy?] then send it back explaining nowhere is there a tick box on the [what they say was] enclosed agreement.Non me fac calcitrare tuum culi0 -
Thanks Taff, that's what I am confused about, they say on the agreement they have sent me (looks like a cut & pasted copy so I would say reconstitued) that I ticked a box opting for PPI, all it shows is my signature confirming the card and some bits about the consumer cresit act and optional tick boxes for marketing-which are not surprisingly-not ticked
however, with the difference in dates as well, and as far as I recall the PPI was added after a phone conversation at point of card activation, not a tick box on an agreement that doesn't even show the tick box- I'm confused myself really...
I'm not sure whether to write back/call them (as I may have to if they send my upheld cheque for my loan with them with the wrong name on it) and mention this or whether to just accept that it was probably on my statements and I should not have been so young and naive and checked!0 -
You'll find very few people who will use the young naive and stupid argument to talk themselves out of complaining further.
If they are rejecting on the basis you ticked the box, and you didn't tick the box, send it back and tell them you didn't tick the box.Non me fac calcitrare tuum culi0
