Can't claim JSA because I haven't paid Class 1 NI!!!

Recently claimed for a week.

Had a letter back saying that, based on tax years ending april 2011 and april 2012 I hadn't paid enough class 1 NI.

Year to April 2011, I was employed normally and earned over £30K.
Year to April 2012, I was employed normally and with redundancy payout earned over £15K.

Surely this must be a mistake?

You don't pay NI on redundancy payments. What was the split of salary/redundancy?

  • How much was the redundancy payment ?
  • Can't remember exactly now but since its based over 2 years surely I should have paid A LOT of NI in the first tax year?

Any idea what the limits are for claiming JSA? IS there any way to find out how much I have paid?

It isn't averaged over the two years - you need to have paid enough NICs in both.

Nope, doesn't work like that. It's the number of weeks you paid NI, not the total amount paid. You need 2 full years (ie 52 NI paying weeks per year).

The payslips will tell you. You do keep them for the required 6 years, don't you?

It's the number of weeks worked too, not just the value.
  • Are you sure its the number of weeks worked? So what happens if you work for 40 weeks then decide to take a break for 12 weeks?

Can't be right. I though it was total for the year.

I always find the calculation really difficult.

Have found this link but it is Northern Ireland but I believe it is the same 'rules'.

    http://www.lawcentreni.org/EoR/benefits-and-tax-credits/jobseekers-allowance.html

    Scroll down to Section 2.

Personally I can't get my head round the figures but perhaps it's the heat!

OP, if I were in your position I would have a read of the link and if you still think you are eligible (or you can't work it out) then ask them to look at their decision again.

    They do make mistakes!
