Parking ticket issue

Hi i need some advice,i have just come away from a car park,which i assume is a private owned,on going to pay for my ticket,the machine was out of use.
I took shot of the machine with my camera to state the day,time,etc,before.
I did notice on a sign that in the advent of machine not working you had to ring a 0141 number and pay by card,which in my case was not a option having a handful of change.
Where would i stand on this ?
Sure these car parks are controlled by anpr camera system.

    Who is the parking company, and is it England or Wales ?

    Star Park are part of Civil Enforcement Ltd, and they do issue small claims, so don't ignore this. Can you tell me if they put a ticket on your car, or they gave you this through the post, if latter did you get the Notice to Keeper within 14 days?

    Putting aside that we advise resisting all penalty charges - for that's what they are, then with them giving you an alternative way of paying, as long as that method was working, you have no mitigation based on your post. You were free to park elsewhere.

    It is different if there was no fall back to the machines, but in your case, there is.

    As said, if sent a NTK, then follow the majority advice on all of the threads here and go via POPLA route.

    OK, then wait for any Notice to Keeper and then come back. Please don't bash out any appeal to the PPC without running it past us first, though.

    Of course you have a case, they are trying penalise you an obscene amount of money, the loss is only at maximum the daily rate of parking. Anything else is an unfair unlawful penalty

    This is a private firm not a real fine. You would have a 'case' not to pay the fake PCN and to win on appeal even if there were a hundred P&D machines all shiny & new and fully working and you ignored them!

    Let us know when you get their laughable 'Notice to Keeper' in the post so you can start the appeal.
