I have emailed them separately and included, in my own words, Bazster's superb point in post #2 about TPS mitigating their losses.

Guys, thanks for all your help again, sorry I hadn't the sense to at least wait and see what you had to say. If anything else threatening comes through the post I will let you know here...

Good God, you are just not listening. I told you to look around here and find some PoPLA appeals to base yours on. Winning PoPLA appeals go on for pages and pages with lots of technical points.

Do you shoot from the hip in everything you do?

It's not going to matter because he has missed the POPLA 28 day deadline, it will be kicked out I suspect. Shame, missed opportunity.

They do allow appeals outside the 28 days if the situation merits it, so lets see
When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

I say no chance as there's no reason for the delay. Let's see. And the POPLA appeal is a bad one even if it gets through (if it does we can help the OP to add to it).

  • Coupon-Mad....I've come across one of your templates here, would this be acceptable to use if POPLA allow me to add to the appeal?

It's your post from 04/07/13 02:03 (MSE won't let me post links as I'm new.)
Thread title "4 hours free parking but 10 minutes over!" (OP 19/05/13 20:31 SuzeWuze)

I imagine that the more likely route at this point is for me to receive more threatening crap, i.e. a Letter Before Action, and presumably this topic will come in handy:

Thread title "Parking - letter before action? Fight back" (OP 15/07/13 20:41 zzzLazyDaisy)

To the experts out there, are these the relevant posts? If not can you point me in the direction of alternatives. Thanks in advance.

PS Bazster, you don't need to be so blunt. I'm new here, got it? That's the big sign under my s/n. I'm not going to apologise again.

You can try but IMHO you'd be better also complaining to the Manager of Halfords and the Retail Park Management. You may be pleasantly surprised when you are assertive about it and show receipts or proof that you/family are regular customers now horrendously offended and angry about this harassment of a paying customer.

    Here's Suzewuze's POPLA appeal, post #33:

    and others:

But the POPLA code is dated within the code. You'll be lucky to get it accepted.

    This notice saying customers only

The exact wording is vital at this stage. Can you get a copy? Reason, I am a customer of Halford. I have a receipt to prove it. But I happen to be at home now writing this.

Unless the sign clearly says you can only park there whilst shopping in the store, then that's one thing, but "For Halford Customers' use" implies no such restriction.

If you lose at POPLA - and I have to agree with the others about your appeal - then you need a decent case for court and we can help.

But check the wording first and if in your favour, get it added to your POPLA appeal.
  • Good news, looks like POPLA have received the appeal and acknowledged it as of today. They mention in their letter that the appeal will be considered on or soon after 26 September and notified thereafter.

At this stage, what would you do? Would POPLA contact TPS to ask them to cease sending any further letters? If so is it just a case of sitting out the remaining time? Presumably the date in September is just for the conclusion of the POPLA appeal and not a court appearance.

TPS should now stop sending letters. PoPLA has nothing to do with court, you are a long, long way from a court appearance and it's unlikely to ever happen.

  • Excellent stuff. I know the appeal wasn't exactly great so I am expecting they will throw it out anyway, at which point I will have to come back here for more advice...
