Housing Benefit Self Employed

If someone is self employed low income but did not want to claim working tax credits, because of all the tiresome question asking that goes with it, could they still claim income based housing benefit? Or would the housing ask them why the are not claiming the soon to be abolished WTC?

    Are they receiving working tax credits already?

    Deprivation of income rules only apply if the claimant stops that source of income to increase their Housing Benefit. If they haven't received that source of income then they can't deprive themselves of it.
    These are my own views and you should seek advice from your local Benefits Department or CAB.

    that isnt what the OP is asking.
    even though entitlement to HB isnt dependant on claiming any other benefit, the OP wants to 'deprive' themselves of income ( by not claiming WTC) and receive additional housing benefit becaue they cant be bothered with all the questions that HMRC will ask.

    the system doesnt allow you to swap one benefit for another through personal choice

    If someone as giving me free money every week for 52 weeks and the only thing I had to do was a spend an hour or so to complete a form then I would fill in that form every week if I was asked to do that!

    I have seen notional JSA used to reduce a housing benefit award (i.e JSA not claimed when entitled to) but not tax credits. (perhaps because the JSA was contribution based?)

    I can't find any links about notional tax credits but would be interested to know if anyone has experience of this.

    Having said that who on earth would not claim their tax credits if they knew they were entitled to them? Go to CAB and ask for some help completing the form if necessary.

    It would be logical in an application for HB for notional tax credits to reduce the payments if only because they would, presumably, be coming from different money budgets. However, no idea if this is what would happen.

    I have only used notional Tax Credit where someone has stopped them and said in a letter that they have stopped them to increase their Housing Benefit. Otherwise we would have no idea why they stopped.

    When we used to treat child maintenance as income if people told us that they had told their ex-partner(s) to stop paying them to increase their Housing Benefit and were that stupid they put that in writing then we would treat them as still receiving that money.

    No its not laziness I can assure you. You have to go through a gestapo like procedure, which can be avoided by just telling the housing what you get and them reducing your housing benefit accordingly. I already though of it and phoned the housing benefit office to ask, a young lady told me off the record that there was no point in me claiming WTC at the same time as housing benefit because it only gets deducted, she said I was wasting my time, and thats what I thought. Si its not laziness, its actually called using your head, you idiot

    Because the money that you claim just gets paid straight back, it get taken off your housing benefit, and it works out exactly the same, if you get 52.00 WTC it works out around 37.00 more you have to pay on rent and 15.00 on council tax.... so what it the point, I just don't see why someone would want to go through all of that hassle. :mad:
