    It's out of time and they can't pursue you as the RK under PoFA. You need to file a complaint with the BPA and the DVLA.

    Carry on and appeal/challenge VCS (in order to obtain a POPLA code) then a strong appeal to POPLA. It is worth bearing in mind that a recent POPLA decision made it clear that any PPC case which is POFA non-compliant (which applies in your case as their NtK was out-of-time) will fail unless the PPC has evidence .i.e knows the identity of the driver.

    I guess the saying is 'it had been too quiet' and I have just received further correspondence relating to my initial post.

    I sent an appeal letter within the 28 days of the 'notice to keeper' letter they sent and heard nothing back and now have received a letter relating to court action and bailiffs which has obviously spooked me a little.

    Would I be best trying to correspond with the parking company still?

    Just when I thought it was all over...

    That is not allowed - they have to respond and give you a POPLA code if they reject an appeal. You need to complain to the BPA, as per the email address and advice shown on two sticky threads ('newbies, read this now', see post #1, and 'successful complaints about PPCs' which has the email addies for the BPA and DVLA in post #3). Email Steve Clark at the BPA now, you only need a few lines and an attachment of the NTK and your response and the debt collector letter (it's NOT bailiffs by the way, it's a letter from a pen-pusher).

    Don't ignore it and don't let this lie because POPLA is the way to go. Only write to the BPA as the KEEPER not driver.

    Quick update,

    I have emailed BPA as the keeper explaining that I received no response to an appeal letter and that VCS have passed it to a debt collection agency.

    The BPA have acknowledged the email and are looking in to it. Should I contact VCS and/or the debt collection people explaining what I have done requesting they put a hold on any collection efforts or just leave it in the hands of the BPA?

    Sorry, just realised I didn't respond to this. Yes, I requested a POPLA code when sending the soft appeal but didn't receive any response at all to the letter.

    in that case there is no rush that I can see so leave it with the BPA as you arent the first with this complaint, and wont be the last either

    It's quite amazing how much mail to PPCs seems to go missing, or at least the mail which is marked "appeal", and accidentally ends up in the shredder. I bet they don't lose nearly as many cheques that get mailed to them.

    I think I am now going to advise sending all post appeals in envelopes marked "Cheque Enclosed" and using the old comedian's joke "PS Sorry but I sealed the envelope before I enclosed the cheque"
