Hi everyone,
My partner has received a letter (a number in fact) of which they have all been ignored. The latest letter is titled letter before action.
We have started correspondence with ParkingEye in order to get a POPLA code as we believe that there is grounds to appeal, as the fine/charge is excessive.
The circumstances are: my partner has parked in a free car park (Aldi store) with no pay and display machine present. Her car has remained in situ for a period of 3 or so hours whilst she has gone for a meal with her work colleagues. Prior to going for the meal, drinks were bought from the store with cash, however this receipt was disposed of immediately. My partner did not notice any signage on account of the car park being in darkness. During this time the store had closed.
Following returning to her car and leaving the car park she has received a wonderful letter from ParkingEye, demanding £40 to paid immediately or it would increase to £70.
Do you guys believe that we would have grounds to appeal?

Who needs grounds. Tell them the fairies said you can park for 3 hours.

By all means try and get them to accept a late appeal and give you a POPLA Code, as that allows you to appeal and hopefully avoid a court hearing.
But please DO NOT IGNORE the letter before action. If you do, you will flag yourself up as a potentially easy target, and may find that you received court papers. ParkingEye have got very trigger happy recently with starting court proceedings.
The good news is that the letter before action (properly called a letter before claim) almost certainly does not comply with the Practice Direction on Pre-action Conduct, and you can use this to your advantage.

We have sent them a generic email stating that my partner is the registered keeper, and that we would like to challenge them in regards to the fine. We will await a reply, and lets face it we know what the reply is going to be.0

Sorry but why on earth does anyone think they've a right to park in a third party car park to do business elsewhere? Presumably aldi provide a car park for the convenience of their customers while they are in the store. Not for someone to freely park in for hours afterwards.
How would it be different for someone parking on someone's drive?0 -
You need to take a look into the Parking Forum for the most current advice on seeing-off Parking Eye. Challenging these jokers at POPLA is the best way and there are several excellent approaches already.0
