Ex-employer Overpaid Me Says I Owe It Back and Has Given Me Ultimatum of 5 Days

    nope if you do overtime you know how many hours you are being paid for, don't you?

    I mean say they were UNDER paying you, how did the OP check that? Maybe theydidn't? Obviously they didn't as they were overpaid say the employer.

    Its the gross pay you need to check to see if the over time has been paid ornot.

    Wouldn't worry too much about the police op, despite the scare mongering. It is technically 'theft' if they have overpaid you and you intend to 'permanently deprive another of property rightfully theirs' - but the police are highly unlikely to show an interest. They've been known to fob off much more substantial cases as a civil matter.

    As for ignoring it, that doesn't resolve it and is a huge gamble. Ask for a breakdown, check against your records and go from there.

    Debt collectors are toothless, they have no powers, let them do what they want. If though it went to court and they failed to provide you with a breakdown or some form of proof of debt, they are unlikely to be awarded court costs.

    Debt collectors = tell them to ''go away'' until they have proof to show you.
    Old employers = ask for complete breakdown showing what was / should have been paid and how it was uncovered

    Then, only then, if you do owe then make them an offer of repayment over time. Most working people can't just stump up a £1000

    Easy to miss over and under payments if pay varies every month.

    Thanks for the replies people. Nice little exchange a few of you had there. Result: got a break down of everything from them in paper i.e. what I'd earned and put it against what's come in to my account. Everything balanced bar the overpayment so I paid back the value. The threat was clearly scaremongering from the moron at payroll whose neck was probably on the line for being incompitent in the first place.

    I'd recommend people do the same if they get this problem. End of the day its not your money unless you can prove that it is. If you have a a-hole threatening you, just drag your heels with it by asking for complete breakdowns and firing a million questions through email there's no real time restriction they can enforce.

    One thing to remember though is keep that ex-employer sweet if they are valuable to you for employment prospects, in which case this one was. Act professionally, be formal, and pay it back if they've clearly overpaid you and all will be fine :)
