Can't say I'd worry if I were you. Responsibility is on the buyers to do their research and if they're looking at buying a flat with a flat above, then they should really expect some noise.

The only problem would be if you'd reported neighbours to the police for noise/anti social behaviour and the buyers asked if you had ever done the same. If you answered No but you actually had, then there may be some comeback for the buyers. But buying a flat with a flat above, they should expect noise!

You shouldn't be sued, but at the same time, if I thought a flat was fairly soundproof before buying and then found out that the soundproofing was bad enough that you could hear normal walking and talking, I'd feel uncomfortable: being intimate with myself or others, having personal conversations above a whisper, watching TV(or any loud activities) late at night (I suffer from insomnia).........I would feel fairly as it would significantly affect my behaviour in my own home.

At uni I lived with several flats above and around, but you could only hear yelling or loud music......
