Default from Barclaycard incorrect ?

Wonder if anyone can help and please be kind ... I used to have an egg card when I was in the process of selling my old house and living with my now husband I got into payment difficulties and had to ask my account owners if I could arrange reduced payment .... all of them very kindly said yes and arrangements were made including Egg ... now this went on for a while with some and short term with others .. Egg was paid on time via dd from my account this was displayed on my credit file as payment arrangement as were the others ... then they got bought out by Barclaycard and as soon as that happened they put a default on the file .... 2 years after the arrangement started ... I queried this with Barclaycard and then said it wasn't them so I sent them copies of my credit file with the default not on and then after with the default on ... clearly after the buy out by Barclaycard ... we had numerous phone calls etc and when I asked to have the paperwork sent to me I got told they couldn't send it without me paying £20.00 I refused and wasn't happy and it even ended up with the operator at Barclaycard offering to pay it for me which I said wasn't necessary ... anyway I went to the ombudsman and they ruled in favour of Barclaycard saying that although it wasn't fair it hadn't been put on from the start it was correct as it should of been there and Egg should of put it there ... I supposed my question is how is that fair that it has gone on way after the fact and I wasn't notified and they cant send me any paperwork to prove it ... by the way it has now been paid in full and showing satisfied I am just a bit annoyed it will be showing on there till 2015 and is affecting my credit rating the only bad thing and we are looking at extending the mortgage next year and feel this may cause some issues ... can anyone advise .... sorry for waffling on :j

    Blimey - all that in one breath!

    It is fair that it went on, but what is the date of default and when did you default? I know you mention two years, but want to confirm this was the difference.
  • the payment arrangement was applied in march 2009. then the default was added November 2011. however it shows on my file as the default starting in march 2009 when the arrangement was put in place . Barclaycard state this is when the default would of been added by egg or should of been .hence it ends march 2015.

    In that case if the default is fair then the date is also correct. Unless you are going to continue arguing about the fact of the default with the ICO instead of the FOS, then I would just accept that.

    I would agree. It seems that you entered into an agreement with Egg, which constituted a breach of the terms and conditions of the account, but Egg failed to report that fact to the credit reference agencies in the form of a default.

    Barclaycard have clearly been performing data cleansing on the account portfolio they bought off Egg, and can see that you fell foul of the original terms and conditions in March 2009.

    They recorded this fact retrospectively on your credit file.

    This is correct.

    Unfortunately lenders are entitled to record your account as in default even if they agree to the reduced offer of payment from the outset - some choose not to, but that's just a choice they're entitled to make.

    At least the default is over four years old now so long as it is settled and your recent history with other accounts is impeccable it shouldn't have a massively detrimental effect on your creditworthiness.

    Yep. The default has been correctly reported for the time it happened. I can understand you being disappointed when you were hoping it would not be added at all.
