Smart parking Ltd - parking charge notice

Hi there
I am new to posting on forums. I have received a parking charge notice from the above with the reason over free time. This was in Asda car park in Worcester where you can park for £1 for 3 hours and then move the car. I came back to the car after 3 hours and put another £1 ticket on the car (as I was running late and was advised to do this by Asda staff). I stayed only another half hour and then left. The notice is as previously described in this forum with 2 blacked out pictures and a number plate. The times of entry and exit are noted. The fine is £40 or £70 if I do not pay within 14 days. I have appealed but like everyone else have had no answer.
Do I have to pay this notice, I have been reading a lot about this company on line. Also I did pay for the amount of time I parked, my only crime was overstaying the stated 3 hours by 30 minutes which I paid for

I have since been into Asda Worcester and spoken to the manager who was completely unhelpful and said that parking at their store was nothing to do with them and run by Smart Parking ltd
I am worried I am going to get a CCJ or someone knocking on my door. Can anyone help?0 -

Also, you don't need to search far to know that all the rubbish about CCJs is just that - rubbish.0 -
Also, when you do go back to the store, fill a trolley with about £200-worth of groceries before you ask for the manager. If he remains as unhelpful as he was before, tell him "well I will not be wanting this lot then", and see how he reacts to the loss of a big sale as you head for the door (don't worry about the stuff in the trolley if he does say he'll cancel the ticket, he's not going to follow you around to make sure you really do buy it all, just put the stuff you don't want back on the shelves!)

A random 'Duty Manager' the CS desk called over - or the STORE MANAGER?! You must complain to the Store Manager themselves (get their name).
Makes no difference even if you were 5 hours late.

Copy this poster and march back into Asda and demand to speak to the Store Manager ONLY:

Dress smartly - e.g. even though it's hot, wear a smart light jacket - makes you more assertive-looking and will help you feel it too! - and take your receipts from that day (and recent weeks if you have more) and the offending fake PCN. DO NOT discuss the issue with the teenager on the CS desk, tell them you want a fake PCN cancelled and you want to complain to the Store Manager in person about this harassment. When you discuss it tell the Store Manager that Asda staff TOLD you that you could pay for the extra time, which gave permission which overrides the agent.
See that linked thread; this can be cancelled in minutes.
Don't take any notice if an Asda staff member pretends they don't own the car park. That's a big fat LIE.
If the Store Manager will not cancel the fake PCN tell him/her you will be writing to Asda Head Office and will also post a complaint on the Asda facebook page...encourage him/her to look at what is currently happening to Aldi on their facebook page over the past fortnight!
Come back and tell us how you get on. Try that first, this weekend, before bothering to try the appeal to Smart.

Stop believing their lie that the car park is nothing to do with them. Smart are agents for...Asda.
Plan B
But if not sorted by Asda soon, send a short challenge to Smart saying that:
'I am the registered keeper and I am responding to challenge your letter dated xx/xx/13. The driver was given permission by your clients, Asda, to pay for extra time as the driver was running late and was a genuine customer (see attached copy receipt). So your t&cs are null and void since the driver was able to rely upon a verbal agreement by your client to pay for a longer stay on that occasion. Also there is no loss to yourselves so clear off or give me a POPLA code.'
P.S. Was the fake PCN received by you within 14 days of the incident?
P.P.S. ''I have appealed but like everyone else have had no answer.'' NO IDEA what you mean as everyone gets a response, they HAVE to respond. So did you appeal to the right email or postal address and did you give all refs & car reg details in the appeal? Did you say you were driving (if so, BIG 'ooops'!! You will notice we DO NOT!).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
