    I am sorry I have not replied to all individually. I came back from office to see so many replies and view from many, and I am glad. Appreciate all your efforts to make things clear to me. I shall update this forum what would happen with this regards in the coming days. Hoping everything settles okay. If the don't agree, then I will continue what I did earlier - only give to family and friends not via parkatmyhouse !! Some friends even pay cash. Anyway I shall update the forum so that it will be beneficial for all.

    Its running a business.

    Planning consent is needed because you operate a business that has the potential to inconvenience your neighbours with lots of comings and goings. In this case if you have people arriving at 4am to get a 0630am flight slamming car doors and talking you are causing a nuisance by your business.

    Unfortunately, the exact same thing has happened to us. We had been successfully renting out spaces in our driveway when we received a letter through from our local planning department. We have been told to stop, as we are breaking planning laws and using our residence as a business. If we wish to continue, we need to apply for a change of use for our driveway, from residential to business. We won't be bothering with that, so have given up renting it out.

    I can only assume that either a neighbour or local carpark owner has made a complaint. :mad:

    the split of the income between you and your wife for tax purposes will depend on how your legal ownership of the property is recorded. Assuming she is an owner then the fact that you have a wife means that she has already breached tax rules because she also should have been declaring this income as well as you
    there are 2 options:

    a) you both own as joint tenants: in that case the income must be split 50/50. There is no other option . That means you cannot take 100% any more than she can. You will both therefore have to declare your share of the income to HMRC and pay tax according to your own circumstances. If she is claiming benefits then this extra income could impact her entitlement. She will pay no tax if her total (taxable) income remains less than £9,440 pa

    b) you own as tenants in common. The share of income must then reflect whatever is the actual split of the property, this may or may not be 50/50. If it is an unequal share (eg 60/40) then the only way you could alter that is to change the ownership share of the house with the Land Registry,

    PS the fact both of you have evaded tax so far does not mean you will get away with it in the future, especially as you are now visible to "the system"

    That's a nice rational response - not so helpful when you notice later that someone seems to have key'd your car - it's just a recipe for disaster.

    Even IF my suggestion had not been tongue-in-cheek, such an arrangement would clearly be made with both parties understanding the purpose. I mean, let's be honest, how many people move in as a lodger the same day (or night before) they go on holiday...?
