Proerty I rent out

Hi,

I rent a property out and next door neighbour has done an extension which was effecting light coming into our property. I compliant to Planning Department and received a letter stating the extension has been done incorrectly and they will refer the matter to their enforcement office. This was sometime ago now but extension is still there. Their was no fence between the 2 property, I have visited the tenants today and they have done another wall between 2 property which is not straight - basically it starts of straight and then bents and uses good amount of our land.

I have spoken with our neighbours but they don't want to listen anything. They told me as I have made a complaint to Council previously I should go back to them again to complain.

What would you suggest?

    Try to negotiate.

    Neighbour disputes are best resolved without recourse to law.

    Failing that:

    * If there is something (eg a wall) on your land, you can remove it. I'd advise writing to warn them of your intention first. Perhaps asolicitor's letter, enclosing a copy of the Title Plans (proving your ownership) and photos (proving the wall is on your land).

    In what way was the extension 'done incorrectly'? Do you know? Haveyou compared the approved Plans with the actual construction?

    Have you contacted the Enforcement Officer to ask
    * what action will be taken
    * When?
    * How long the neighbour will be given to rectify
    * what further action will happen if the neighbour does nothing?

    Enforcement is a slow process, esp if the neighbour is uncooperative, and/or puts in an Appeal
