J D Williams help!!

Looking for advise please and please don't be so harsh to judge! So I have several j d Williams catalogue totalling balance of about 7k. My partner and I split in December and I was left to cover all household bills rent etc alone. Only on a small wage I fell behind payments and got into massive mess. I finally plucked up the courage to speak to people and sorted out repayment plans. J d Williams accepted my plan to them but the interest they charge me is more each month than my monthly plan so I'm getting nowhere? What do I do I'm trying to sort out my debts but there not helping me

    Have you asked them to freeze interest? If so, what did they say?

    I'd consider contacting a debt charity such as step change.

  • I've asked them too but they refused too! Really haven't a clue what to do I've googled this and a lot if people say I should cca them? What's this? I think it's where I ask for a credit agreement which I never signed and put the account in dispute until they agree to stop all interest??

    CCA requests are intended for when a creditor is chasing people for a debt they don't know about, or dispute is theirs. You've been paying your debt off so it's not really appropriate here.

    I would speak to Stepchange as they may be more likely to listen to them.

    If the catalogue account was started pre-April 2007 then under the Consumer Credit Act (s127(3)) a properly constructed agreement should have been signed by the person taking out the agreement. If not, the agreement is rendered unenforceable.

    Very often catalogue companies would send out a blank copy but not be too fussy about whether the client ever returned it. J D Williams were the worst offenders. If they were asked if they had a signed copy (not necessarily by a formal request) they would often hold up their hands and agree not to pursue the debt.

    Your account may date from after april 2007 and so that argument would not apply. However, you can still make a formal request for a copy under s77/78 and the agreement is unenforceable until they comply. They can comply with a reconstruction.

    I have to disagree with mattye. s77/78 CCA requests are not appropriate for when a creditor is chasing people for a debt they don't know about, or dispute is theirs. The right only extends to the account holder. Fermi explains this in post#2 here

    There's no point in being on a payment plan where the interest is more than the payment. So a legitimate s77/78 request is a good starting point. See what they come back with.

    Perhaps I misunderstood the purpose. I thought someone would send a CCA request following the letter in the first post in the thread you linked to, if the creditor was still chasing for the debt.

    Kinda like saying, "If you think I'm responsible, show me a valid credit agreement."

  • These were taken out in 2010! Really don't have a clue about cca or anything like that does anyone have a form so I could at least get these account in dispute as the interest there adding is so high. I have no problems paying for the goods I've had and no issues with some interest but if there not helping me this will be an endless

    The cca template is in the factsheet I linked to earlier. The 'freeze interest' template is for use if you ask for interest to be frozen and they refuse.

    We sorry that you feel unable to suspend interest charges on the above account. [ALL] of our creditors have agreed to suspend interest charges still accruing. They have accepted that to continue to charge interest would not assist us in our present financial difficulties, and can only serve to increase our total debt.

    (As you are aware, we have already paid considerable sums in interest to we account. If interest charges continue the monthly instalments we are paying will not even cover that interest. Also, the cooperation of we other creditors who have agreed to freeze interest already could be put at risk).

    We would therefore be grateful if you would reconsider your decision not to freeze the interest. This would mean that the monthly payments we make would actually reduce the balance owing to your company.

    We look forward to hearing from you as soon as possible.

    jd Williams are scum they never stop charging interest or adding charges I couldn't pay what they wanted but paid every month what my dmp said for a year they constantly harassed for more money and after a year my debt to them had almost doubled because of all the interest and charges.
    Stop paying and eventually they will pass on to an outside debt company (not reliable collections) mine ended up with MDR they stopped interest straight away and accepted a very low monthly payment.
    if you don't want to stop paying then just pay £1 per month and ignore calls and file letters and forget about it until they pass it on.
    Do not talk to them on the phone they lie and try to scare and even threat you, mind the are clueless and have no idea of the law.

    That's all fair comment!

    Sometimes you just delay them selling the debt and interest getting frozen by making payments.

    There's a small possibility of court action, but the op may have no say 'no more payment unless you freeze interest'

    Could still start polite though.
  • Hi All,

    Ok so I finally got a response today from reliable Collections yesterday. they sent me copies of my credit agreements which had basically been filled in the day I asked for them. I know the accounts were taken out in 2011 so these dont really matter so ive been told??
    In the letter they have stated all the monthly plans which I had set up and theinterest being charged etc and that i should be grateful of the plan and thankful no court action had been take.
    I stated in my letter to reliable collections that I was only going to be making token payment of £1 per accoutn until a suitable repaymet plan was arranged and where all interest and charges but then at the bottom of there letter they also stated the same and said until a mutal agreement is made they cant do anything with my accounts?

    Please someone advise me where to go from here? Im not looking to get away with what I owe them I honestly do want to pay for the things I have had and get this debt cleared but they keep wacking on the interest every month!
