Claim against landlord for breach of quiet enjoyment-Protection from Harassment Act

Hi all,

I would like to know the process for making a claim against my landlord for breach of quiet enjoyment of the property/harassment.

He has assaulted me few months ago through his daughter and yesterday this last came again in the property with warning to threat me.

Two weeks ago they have changed the house front door locks and I had to sleep a night in an hostel (while I was revising for my lasts examinations).

    "Small claims" is for money, not resolving criminal behaviour.

    I'm with thesaint; what you are talking about is criminal behaviour so the appropriate response is to inform the police.

    Small claims court is for getting money that you are owed. If you want to go that route you first need to fairly calculate what the monetary cost to you is of them breaching the terms of your tenancy agreement.

    Seems strange to me that what you want is a monetary settlement and not the resolution of the problem, or maybe you believe this is a resolution.

    I would suggest you move.

    I think this may be the second or third thread this poster has started about the same situation, just different aspects of it.

    OP do you have any witnesses to their harassment and the assault?

    Yes, this part is done and the police has told me to send them to the court.

    Few months ago when I have been assaulted, the police came in the property but they were unable to prosecute because I did not have any witness and the landlord lied to the police.

    Presently, I have obvious proof of harassment and I do not have any other choice to sue my landlord in order to make him stop harassing me, the time I find another property.

    Few days, while they well know I was doing my last examinations they have made a party in the property during three days.

    Yesterday, my landlord through all my items from the kitchen.

    How are they having a party in the property and throwing your things out of the kitchen? Do you share the property with the Landlord?

    I think you misunderstand the purpose of the Small Claim court - this is usually a route to gain monetary claims for financial loss.

    I share with other tenants that seems to are relatives or friends of the landlord.
