Highview ltr, will only provide POPLA code on appeal

Hi, i received a parking charge notice on 21st June for an overstay in tesco, hull. As suggested on the site i responded denying liability and requested the POPLA code. I sent this via email on 4th July to the email address on the charge notice only to have the error that it was undeliverable so i printed it and posted the copy.

I have now received a response from Highview:

Dear Madam

Thank you for your letter concerning the above Parkng Charge Notice. We are fully aware that this is a standard letter.

We can only provide a POPLA code if the driver has made an appeal, outlining any mitigating circumstances that they believe to apply, and we have rejected it. A demand to either cancel a charge or provide a POPLA code does not constitue an appeal. If you wish to make an appeal, please do so, so we may accept or reject it accordingly. We will hold the charge for a further 14 days

  • So make an appeal. Doesn't matter much what the appeal is, as you know it'll be rejected. Alternatively, quote the BPA CoP at them which says that a PCN can be appealed or challenged. You are doing the latter. To be (mildly) fair to them, a challenge with no real reasons why the charge shouldn't apply isn't really an appeal or a valid challenge. You could always try the Parking Prankster's radioactive spider appeal (or whatever it was). As I said, it doesn't matter the content of the appeal.

    The ones you will probably use in your POPLA appeal are:
    1) You do not have a contract with the landowner as per BPA Ltd CoP 7.1 and 7.2
    2) Your charges are not a true pre-estimate of loss as per BPA Ltd CoP 19.5

    You might as well go with those

    You should respond thus:



    Dear Highview,
    I am the registered keeper and I have already challenged the basis of your fake PCN. If you would like another reason then how about 'the Parking Prankster ate my hamster'? The point being, it is not for you to to dictate what I say in my challenge and neither can you insist that it comes from the driver (especially as you wrote to me, the keeper!).

    POPLA code please - or cancel it before I email Philip Clarke, CEO of Tesco and I will also make a formal complaint to the BPA and DVLA AOS Compliance Manager as you are out of line not to recognise a denial of liability from a keeper as the challenge that it was intended to be.

    I have a real problem with confrontation and need all the help i can get lol.

    I did actually consider writing to Tesco as, during my stay and overstay i would estimate i spent about £150 both in their store and at the petrol station :huh:

    Yep, see post #7 here I just added on pepipoo (as SchoolRunMum) with a summary of options on complaining to Supermarkets get these fake PCN threats cancelled easily. The email complaint to the CEO option might be best for you!

    Apart from these PPC World Fantasy Rule Book contraventions the law of the land applies
    1) Highview do not have the requisite interest in the land to form a contract for parking with a motorist
    2) Highview's charges are penalties and not a true pre-estimate of loss as required by contract law

  • i am a newbie here and just scouting through all the info as i too received a letter for a parking fine and trying to work out which is the best option, do i email Highview or attempt to go into Tescos and see if they can cancel it, i had kept my receipt but when i went to get it out the bag today its not there grrrr

    Please start your own thread. But the answer is, do both. Strikes me that (for anyone who has a supermarket charge but can't find a receipt) it would be a good idea to go during the day, fill your trolley with goodies, and then collar someone and ask to speak to the manager. You standing there with £200-worth of stuff in your trolley, which you haven't paid for yet, ought to focus his/her mind.
