DLA award

Hi everyone.

I have been posting in a seperate thread (ask and ATOS rep) regarding questions I had for my Mums DLA claim. The responses I received were hugely helpful and last week my Mum received her award letter. She has been granted higher rate mobility and lower rate care; looking at the descriptions I think that seems about right and it's a huge weight off her mind. She received the award letter on Wednesday and a backdated amount on Thursday in her account. I just had a few questions;

1 - she did not receive a breakdown of how much she should receive; having looked online I now know the amounts but the backdated amount seems to only work out to be for the mobilty element. Would they process the care part seperately?

2 - Is the process to claim for ESA (which I sent off last week) as drawn out, and is she likely to receive this as she has now been awarded ESA?

I also wanted to add that I found the whole process extremely stressful and I am not the one with a condition. I feel a huge amount of sympathy for anyone that has to do this for themselves, whilst also dealing with any sort of condition, and wish everyone luck.

Luckily we didn't have to deal with ATOS in the end - I don't know if my request for a specialist had anything to do with this, but in the end they were happy with her cardiologist and GP report.

As a final note, I realise that everyone's experiences will be different but I found everyone that I spoke with to be very nice and polite, and for the most part, helpful. I was expecting something different so I am happy to have been proved wrong.

  • They should have paid out the £21.55 backdated LRC at same time as the HRM. So ring them and ask them why it seems to have been missed.

Hi pip, I am glad your mother was successful with her DLA claim. With regard your first question you do usually have a breakdown of the amount that you will receive in a letter.

Your second question, the process for ESA is also quite stressfull and can take weeks. The fact that she has High mobility DLA and Low rate DLA has nothing to do with ESA. I receive High rate DLA in both mobility and care and I was placed in ESA WRAG (work group) and when I appealed it took approx 3 months for me to receive their decision - I was placed in ESA Support group as they reconsidered my claim. Luckily I did not have to go to tribunal.

    Good luck.

That does sound stressful!!! Hopefully it doesnt take too long as in the meantime they have stopped the housing benefit she was receiving which will cause more issues with the housing association.

    Fingers crossed!

If you have applied for ESA then, as already said, the award for DLA will not make it an automatic entitlement as they only refer to the descriptors.

Your Mum should receive the assessment rate for ESA whilst her application is being assessed.

As regards the HB it can be claimed on the grounds of a low income (if this is relevant). You do not have to be in receipt of a particular benefit.

Thanks for letting us know of your success. :) Alas, there are a lot of people who ask for help and who are given an abundance of advice, but never let us know of the outcome, so I'm really pleased you have.

When my friend received her backdated amount, she had separate awards for Mobility and Care. I thought this odd, but that's the way it was done. HTH and I'm so glad you didn't have the ATOS visit - my friend had 2!

    I did mean DLA :)

It is relevant; I filled in a nil income form for her HB last week. This particular council are very difficult to deal with - they send letter after letter contradicting themselves and it's just near impossible to know what's going on. She has received another letter this morning stating that her award has been changed again so hopefully this means they are paying her HB again. I will check after work.

    Thanks for your help!

    That sounds terrible!!!

No problem at all, I am extremely grateful for the advice. People go out of their way to help others on this forum and I think it's fantastic. :A

I'm so glad she didn't have to have the ATOS visit and that I was able to deal with it for her becasue the prospect was really causing a lot of stress. With her heart condition that was obviously something I wanted to avoid.

    Hi Guys

I sent the ESA form off a copuple of weeks ago and she received a letter back today requesting a medical certificate. I spoke with them and as soon as they receive this her payment will be released so i'ts been sorted pretty quickly :j

She will receive £143.40 every 2 weeks, along with the DLA payment.

The housing benefit and council tax are also sorted so it seems everything is done for now!

She will have to have a heart operation unfortunately, but this is a weight off her mind at least.

Thanks again for everyone's help. :A
