Claim credit card under Section 75 for overcharge?

I placed an order from an online store and received a written order confirmation. Based on their T/C, this order confirmation constitutes the final contract. However, after the good was invoiced and delivered, I found they charged £10 more than the confirmation. I thought it's a simple matter of refund of overcharge but after three weeks, I am getting nowhere. They never contacted me back despite of many promises. When I call their 0844 numbers, they found all kinds of excuses like "they could not find the invoice (how could that be?)" or "the sales person made a mistake but she is ill and don't know when she will be back", etc.

I am fed up with them and thinking of sorting it out indirectly. The choices I have:
1) Claim on credit card: the total amount is over 100 and I paid all in credit card. I read through Martin's article on Section 75 and it mainly talked about faulty goods or store gone bust. Can I claim an overcharge based on Section 75?
2) Through CAB and trading standard. Not sure what I can achieve in this way;
3) Through small claim. This can take time and energy. Can I claim extra if I go this way?

Any advice is appreciated. Thanks.

    If you call the Citizen's Advice Consumer service they'll be able to give you advice about a course of action - they don't take action on your behalf but can advise you so that you can resolve the situation yourself (including talking you through s75 or small claims processes).

    Trading Standards generally only get involved if there is suspected criminal activity or if there is a wider problem with the way the company operated that means consumers are disadvantaged on a larger scale - an individual case of a £10 overcharge won't get on the radar for TS.

    In short, call CitACS on 0845040506 and they'll walk you through what you should do.
    Common sense?...There's nothing common about sense!

    Phone your bank, not sure if they can do a partial chargeback or not
  • Fairly straight forward this one!

    Tell the credit card company you were overcharged and provide the original confirmation and they'll reverse a portion of the charge. It's best that you pay off your monthly statement first however as disputing a charge can incur interest that you would have to pay!
