Parking Eye (Again )

Hi, just some quick update advise required please. My daughter parked in a supermarket car park after 6pm thinking it was free after 6pm. Later to fined she received a Parking Notice from parking Eye. You know the one, it arrives with not much time to pay before the price goes up and has a photo of your car on it.

My wife received one of these a year or so back and we just ignored it and the following threatening letters. We heard no more about it.
(It was a worrying time but after receiving advise from this forum and reading about the case that Parking Eye lost when they took someone to court. We decided on this stance )

I understand that there may have been some changes in the law and wanted to know if it is still best to ignore these notices. The notice is sent to the registered keeper of the car, is it still the case that you do not have to divulge information as to who was driving the vehicle as you would have to do so if it was as official Police Fine. Therefore, if the case was taken to court by Parking Eye would you have to state who was driving ?

Any other new advise I can pass to my daughter would be great.

    1) is your daughter 18 or over?
    2) is this in England or Wales?
    3) did she receive the notice to keeper within 14 days?

    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    You do not have to state who was driving but why have you not just complained to the Supermarket about this harassment yet and got it cancelled? Wasn't Aldi was it?! :)

    People do ask how to persuade a Store Manager to cancel the fake PCN. Easy IMHO!

    By being polite but assertive, going in dressed smartly (deliberately to look professional), take your recent receipts and the fake PCN letters and slap them down on the CS desk! Demand only to speak to the Store Manager (do not accept a 'Duty Manager' off the meat counter!). DO this in front of customers but remain icily polite but insistent that the fake PCN is harassment by their agent and he/she must make a phone call to cancel it before you take the matter MUCH higher.

    And/or email the CEO of the Supermarket, as some have done before very successfully. This isn't on, why should your family be threatened like this even if it was out of store opening hours (one of the examples below was similar and Aldi cancelled it this week when the OP complained)!

    She is over 18

    It was England

    letter arrived around 7 days after the dated letter was written.
    payment to be paid within 28 days £85
    discounted to £50 if paid within 14 days
    Letter arrived 7 days before the discounted price of 14 days.

    Another piece of info I now have is that the Car park sign states that 'Parking onlyfor use whilst in the store '

    But that parking tariffs apply 24 hours per day. Well as the Supermarket in question does not open 24 hours is this not conflicting information on this sign ?

    Yes it's conflicting signage (typical of a private firm) and that's the first in a whole load of stuff you will notice and can include in your POPLA appeal in due course.

    Anyway read the links I gave you too and complain first as that's the easiest way to get it cancelled. If the store are useless - in spite of an assertive conversation with the Store Manager only - then you will need to follow the appeals procedure as is covered on pretty much every thread here.

    Yes the letter was received within 14 days of the incident date.

    I appreciate the procedure that can be followed in the links you provided. Is there still any mileage in just ignoring the Parking Notice and any future correspondence from Parking Eye as I did earlier last year. That was what was being advised back then !

    ParkingEye are currently filing hundreds of court claims (some observers believe maybe 500 per WEEK!) so you might think it best to follow the advice given here and get the thing killed off at POPLA.

    If that is the case why are we not hearing more about these on the forums. be interesting to know how they end up. If they are filing so many (if any ) CLAIMS.

    Huh? We are hearing LOADS about them, the number of threads has SOARED in recent weeks. But how many people who receive one of these things do you think ever discover this forum, or PePiPoo? One percent perhaps?

    Someone on PePiPoo counted up and concluded that the number of threads there about ParkingEye court claims has increased something like 20-fold in recent weeks.

    But hey, it's your funeral, go ahead and ignore them since that's what it seems you want to do. Not sure why you posted here at all since you seem to have made your mind up already.

    Not at all, just getting an all round view on things for my daughter to decide. It is not me who received the Notice. The other thing is that I sometimes wonder if some responses to post comes from parking Eye trawls to frighten us off.

    Nope you are wrong PE have put in hundreds if not over 1000 claims since May, mostly to 'ignorers'. Posters here and on pepipoo are helping to defend them and there's been a FOI request to find out the numbers of court claims = loads! This forum and pepipoo is FULL of small claims cases if you just search the forum for 'Northampton' you'll see loads.

    And if you look at pepipoo they are obvious from the headings:

    PE and CEL being the main but not the only perpetrators.
