Ramada Hatfield Parking Eye

My Dad received a PCN from Parking Eye as we were in the car park for about 45 minutes speaking to his friend, it was broad daylight and neither me, my dad or his friend saw any signs yet they are demanding £60 now or £100 by the end of July, they have a picture of his car number plate entering and leaving the car park (although they have got the model of the car wrong) should we respond at all as we were not patrons of the hotel?

I have read the consumer forums and the MSE forums and even a few vids on Youtube but has the law changed?

    If you had read the threads here, you would be fully aware of the Post Oct 2012 changes and current situation regarding appeals to POPLA etc.

    So all the info and advice on Parking Eye in the Current threads and stickies is good for sorting yourself out. :)

    Hi there, some things have changed like keeper liability etc in England and Wales only. With parking eye we do suggest challenging them with a generic soft appeal then when rejected to go to popla the independent appeals.

    Can you please remove anything that identifies you, anything with dates in we don't really need, the same as the location we don't need that either. Read my signature below. All we need is did you receive the letter within 14 days of parking ?

    Dear Parking Eye,

    In reference to the speculative invoice xxxxxx dated xxxxxx, the keeper denies all liability to your company as it is an unlawful punitive charge, thus a penalty! If you reject this challenge the keeper requires within 35 days a popla verification code for them to appeal independently, per Version 3 of the BPA Code of Practice.

    The keeper has nothing further to add, and will not respond to any generic correspondence from your company unless it contains the popla code, furthermore the keeper is fully aware that you must pay £27+Vat for this, so don't forget!

    The challenge will be deemed accepted if there is no popla code on any rejection that you supply within the time-frame stipulated above.

    If he was also a patron of the Hotel he should also complain to the Manager immediately and threaten to put a very bad review on TripAdvisor.

    As well as sending the above letter. Which by the way is unlikely to get a cancellation of the fake PCN but should get him a POPLA code. And then we can help him to win with certain wording to POPLA.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
