UKPC - fine for leaving car park

Just to update on this:
1. Unfortunately my cleaner has binned the receipt from the range (which is annoying but I hope / assume is not vital);
2. I spoke to the retailer whose car park I had parked in (or so I thought). Apparently it isn't anything to do with them, so no help there (wonderful customer service!).
3. Just received the parking charge update from UKPC. I would assume now is the time to begin contesting the notice?

Yes now is the time to start the appeal to the ppc.:footie:Regular savers earn 6% interest (HSBC, First Direct, M&S)

Why lie about something that is scamming you for shopping?
This is not a parking fine. Only The Police and Council appointed Traffic Wardens can issue them. It's a speculative invoice for monies over an assumed contract between you and UKPC. 99% of the time these are unenforceable and with the right advice and on-line searching, you will have to pay nothing. Our current success rate is 100%.
You have four options:
1) Pay up, by why would you? It's a genuine error and the request for monies is greater than the alleged offense of zero cost to park
2) Complain to The Store Manager. Speak to them (not the Customer Services desk, or The Duty Manager. Tear them off a strip and let them know in no uncertain terms that they will lose your custom and that of all your Family and friends due to these scammers. They have the power to cancel the charge
3) Ignore. You will receive a large set of colourful junk mail through the post, but the chances of them taking you to the Small Claims is minimal, although it is a risk. You will also miss the chance of appealing to PoPLA
4) Send in a soft appeal to UKPC stating that you are not liable to the charge and do not recognise their authority to issue charges on behalf of the Landowner/Landlord. If they do not cancel the charge and reject your appeal, require a PoPLA code. They will reject your appeal. Search for the post with the phrase in my signature and send in an appeal to PoPLA using this, tailored to suit your situation. PoPLA's on-line form has a character limit, so follow up with an e-mail directly to them.
Our success rate at PoPLA is 100% using this or a similar defense. Mainly because despite what is stated on the UKPC web site, their claims for monies can be unenforceable in certain circumstances. We are not here to help people avoid genuine charges, but in cases of error, or unfair charges, we will help.

Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

No no no no no. They lease the UNIT, not the car park. That's nothing at all to do with them.0 -
When this sane scenario happened to my visitors, I obtained a copy of the planning consent which stipulated non-charging car park for use of retail units and surrounding retail and residential area.
With some rather militant letter writing and embarrassment of the local council planning department and business rates team for failing to collect over a hundred thousand pounds in the correct rateable value the parking Scammers vanished over night, the signs were there at bed time one evening and gone by morning.
The Council refused to discuss the matter further, but gone they were and they have stayed gone.Be happy...;)0 -
If the Range lease the land, they are not the landowner. Now the Range may have a contract with the PPC, but do they have a contract with the landowner that allows them to engage a PPC and charge for overstaying.
This could affect the landowner's rateable valuation.
So, this may give me a chance to test out my other thread's point about "are we missing something".
I don't know how long the Range have been there or when they last applied for an " overstay chargeable" car park, but if it was post 2009, can you check with the planning departments' planning applications on line.
At the end of the application, the applicant will have had to sign certificate A,B,C or D. That will determine whether they are the owner or leaseholder of the land.
If leaseholder, then the contract with the PPC is not between landowner and PPC and if the PPC claim that, you can challenge it at POPLA and demand not only sight of their contract with the Range, but Range's contract with the landowner.0 -

We realise that, which is why in a multi-store Retail Park you simply 'up the ante' and complain to the Management of the Retail Park instead. As has been said on loads of threads resulting in these complaint successes, many of which are about Retail Parks, where the OP has succeeded simply by Googling the name of the place, reading who runs it and ringing up or emailing a complaint!

The recent thread all those other success links sit on is a classic example of trying to complain to he store (Tesco in that case) and then moving on to the Retail Park instead rather than just giving up. Remember, SOMEONE is responsible for that racketeer being in that car park and that's who you complain to!
Try that first, this week. And if you exhaust that avenue then appeal - as you will read on pretty much every current PPC thread (England/Wales) on the forum you care to click on. Loads of examples of appeals on loads of threads here but try the assertive complaint to the right people first.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Just to update on this - I exchanged a couple of letters with UKPC, one of which was quite simple (ie "I do not recognise your right to charge this penalty") and a long one containing numerous reasons why I felt the penalty notice was invalid (using points pinched from this website.
Very much to my surprise, after the second letter I received a response from UKPC accepting that they would cancel the penalty as a gesture of goodwill - so thanks for the help to everyone on here!
